T09OT01100 ADDRESS: 2646 East Commerce Center Place Tucson, AZ 85706 PROPERTY OWNER'S NAME: HAM Tucson, LLC. The Developer/owner is authorized to use a portion of the flood hazard area in the City of Tucson near the property described as: USDA Forest Service - Tucson I.O.C. A portion of "Block 2" of Tucson Airport Commerce Center, Book 51, of Maps and Plats Page 25, SECTION 8, T-15-S, R-14-E, G.&S.R.M., for the purpose of installing a retaining wall and all associated excavation work and drainage structures, within a regulatory floodplain area as shown on the subject project Grading Plan included in the Development Package #D09-0011 (see plans for additional details). The Developer/owner agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the Developer/owner. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit. The following conditions shall apply to this permit (Refer to Chapter 26 "FLOODPLAIN, STORMWATER AND EROSION HAZARD MANAGEMENT" for additional information): 1. All work shall conform to the subject project Grading Plan included in the Development Package #D09-0011, which is made part of this permit (See Detail S/10 for additional information). 2. The required depth of the retaining wall footing shall be determined by the soils engineer, but shall not be less than 3'. 3. The disturbed soil, around, underneath and behind the proposed structures, shall be treated based on the geotechnical engineer recommendations and shall be compacted to least 95% density. 4. The existing drainage patterns shall not be obstructed or diverted other than what is shown on the attached approved grading plan. 5. Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "Construction proceeding under requirements of City of Tucson Floodplain Use Permit No. T09OT01100. For more information please call 791-5550." 6. Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. 7. This permit becomes invalid and is subject to additional floodplain review, if any required development permit (s') changes the configuration of the structure and or site development. This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions set forth in this permit are not complied with. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Division.
