Upon re-inspection conducted on May 17, 2010, all noted violations were abated and in compliance with the 1994 UFC, 2006 IFC w/modification and in agreement with your approved plans, as well as, your Covenants, Conditions and Restrictions dated March 21, 1985.

RE: Fire Lane

Dear Mr. Roberts

The Tucson Fire Department has conducted a fire safety inspections at the above stated property on October 29, 2009. At that time a notice was issued certified mail indicating the corrections required to provide compliance with the applicable codes, regulations and ordinances. Subsequent re-inspections were conducted on November 25, 2009, and December 15, 2009. Several phone calls have also been exchanged regarding the fire lane. Time extensions were also granted to get contractor to bid and schedule the work. We have been unable to gain voluntary compliance.

This letter is to inform you that if the above stated necessary corrections have not been completed by December 29, 2009 a citation will be issued which will require an appearance by you in court with a probable fine.

This letter is written as a courtesy to you in order to avoid future litigation.

12/14/2009 COMPL - INITIAL INSPECTION Approved I received a call from Tanis Duncan on December 10, 2009 informing me that the association has retained her as their Lawyer. I agreed to meet her at the property on Tuesday December 15, 2009.

However, this is also the date on my second re-inspection of the property. To date the sign have not been installed.

RE: Fire Lanes In Desert Cove Community

Dear Sirs,

The Tucson Fire Department has conducted a fire safety field inspection at the Desert Cove Community located on Candlestick Dr. on October 29, 2009. At that time it was noted that the streets in this community measure at approximately 29-30 feet wide.

Streets that are more than 28 feet wide but less than 36 feet wide are required to have posted fire lanes on one side of the street. Compliance is required by the 2006 International Fire Code (with modifications):

Section D102 Roads. Roads 20 to 28 feet in width. Fire apparatus access roads 20 to 28 feet wide shall be posted on both sides as a fire lane. Roads greater than 28 and up to 36 feet in width. Fire apparatus access roads greater than 28 and up to 36 feet wide shall be posted on one side of the road as a fire lane.
Exception: Roads 34 feet or wider with wedge curbs on both sides, need not to be posted.

The Tucson Fire Department is committed to the protection of your property. Your help as a business owner, property management and as a citizen is greatly appreciated. A Re-inspection will be performed on or about November 25, 2009.
