COURT HAS A COMMERICAL GRADE LIGHT INSTALLED PRESUMABLY FOR NIGHT USE; LIGHT WAS NOT LIT AT TIME OF INSPECTION. THERE ALSO APPEARED TO BE LANDSCAPE LIGHT AROUND THE PERIMETER. AREA TO THE EAST OF THE COURT HAS BEEN GRADED INTO A ROAD TO ANOTHER SECTION OF THE PROPERTY, PRESUMABLY FOR CONSTRUCTION ACCESS UNDER PERMIT T08CM01799. THE COURT HAS A CHAIN LINK TYPE FENCING OVER 6'0". RESEARCH SHOWS THAT THE COURT AND GRADED ACCESS ROAD WAS BUILT WITHIN A "NATURAL UNDISTURBED OPEN SPACE"-NUOS AREA AS INDICATED ON THE SUBDIVISION PLAT MAP (S01-042). THE ADDED COURT CAN BE SEEN ON THE 2008 PICTOMETRY PHOTO, BUT NOT ON THE 2006 VERSION. PERMIT T08CM01799 WAS APPROVED FOR AN ADDITION BUT DID NOT INCLUDED THE ADDED COURT, FENCE OR LIGHTING, NOR INDICATE THE NUOS AREA ON THE SITE PLAN. ALSO PERMIT T08CM01799 DID NOT ALLOW FOR GRADING, AS A SEPARATE PERMIT WOULD BE NEEDED. IF GRADING AND THE ADDED COURT WAS DONE WITHIN THE NUOS AREA, AS IT APPEARS, MITIGATION WITH DSD OF THE REMOVED VEGETATION WILL BE REQUIRED, INCLUDING PENALTIES, FINES, AND REMEDIES.
