02/24/2021 T.C. Ch. 16, Sec. 16-13(b) ACCUMULATION OF REFUSE PROHIBITED. Each owner, lessee, tenant, resident or occupant shall maintain a property so it is free of accumulated refuse and debris. Accumulated refuse and debris means contained or uncontained refuse and debris that is present on the property in a manner not authorized by the Tucson Code. Material recycling facilities meeting the requirements of section 15-24.7 are exempt from this prohibition.
02/24/2021 T.C. Ch. 16, Sec. 16-13(h) OUTDOOR STORAGE Outdoor storage on residential properties is prohibited under the following conditions: 1. When stored in the front yard. 2. When stored in the side yard or rear yard and is not screened by a minimum five foot high solid wall or opaque fence. 3. When exceeds 25% of the total lot area. 4. When stored in an open covered porch that is visible from beyond the boundaries of the lot. 5. When stored in an open carport that is visible from beyond the boundaries of the lot where the amount of storage restricts an automobile from being properly stored within the carport. A double carport will require enough space to store two automobiles. 6. When storage items include garbage, refuse or debris.
02/24/2021 T.C. Ch. 16, Sec. 16-14. Dilapidated structures; vacant and unsecured structures; buildings and structures constituting a nuisance. (a) Dilapidated structures. Buildings or structures that are so deteriorated, damaged, dilapidated, or in need of repair so as to present a threat to the health, safety and welfare of the community constitute a nuisance and shall be abated by repair, rehabilitation or demolition as provided in Article VI of this chapter.
02/24/2021 T.C. Ch. 16, Sec. 16-14(b) Vacant and unsecured buildings or structures are unlawful and are prohibited by this chapter. The requirements of this subsection (b) shall apply to all vacant and unsecured buildings or structures regardless of whether or not the building or structure is surrounded in whole or in part by a fence or wall. (1) Duty to clean, secure and prohibit trespass. The owner or responsible party of a vacant building or structure shall remove any accumulation of weeds, combustible waste, or refuse from the interior of the building or structure and the surrounding yards; and shall secure all doors, windows, and other openings to prevent unauthorized entry. The owner or responsible party also shall post both the structure and the exterior premises with signs to provide conspicuous and reasonable notice prohibiting entry (i.e., "No Trespassing" signs).

02/22/2021 INSP - INITIAL CODE ENFORCMENT BERMUDEZ Approved on site at 4020 E Lee St., accompanied by Inspector Slaiwa. We met the property tenant Ms. Crystal Hart, we walked the property, she spoke about all her concerns, I answered all of her questions, we went over different options of abatement for some of the violations found. My findings: Outdoor storage in rear and side yards to include but not limited to; auto parts, boats and trailers, not properly screened Outdoor front yard storage Refuse and debris Unpermitted storage container Multiple inoperable vehicles to include an RV (no evidence of anyone living in it, plugged into battery tender) Unapproved portable toilet in front yard The detached two-story garage was part of the compliant due to a broken window. The window in question was recently boarded and painted. There is still one missing window, one missing entry door (on second level) and a missing garage door to the ground level structure. In place of the garage door, the tenant has hung a tarp which is not permitted, there is storage being kept in garage on the ground level. Per my research on previous case history, there was a fire inside the garage, and the Inspectors actions were that the structure was unsafe to occupy and permits would be required inspections conducted prior occupying. The tenant is fully aware that I will be sending a notice of violation to the listed property owner and I will send a copy to the tenant at the property address.
10/14/2021 INSP - FOLLOW UP CODE ENFORCE BERMUDEZ Approved ON SITE; CRT FOLLOWUP, THE STORAGE CONTAINER IN REAR YARD HAS BEEN REMOVED ALONG WITH ALL OTHER OUTDOOR STORAGE ON THE PROPERTY. SOME REFUSE AND DEBRIS FOUND ON THE PROPERTY. THE 2 STORY GARAGE REMAINS CONDEMND, NOT ALLOWING FOR OCCUPANCY AND OR ITEMS PLACED WITHIN AS NOTICE OF VIOLATION STATED, THERE ARE STILL ITEMS INSIDE THE STRUCTURE AND IT APPEARS SOMEONE IS REMOVING THOSE ITEMS. THE GARAGE HAS NO POSTINGS AS DIRECTED BY INSPECTORS NOTICE, THERE ARE STILL UNSECURED OPENINGS TO THE BUILDING, NO PERMITS HAVE BEEN OBTAINED TO REPAIR UNAPPROVED BUILDING FROM THE FIRE DAMAGE. TOOK PICTURES FOR COURT HEARING.
