Description:
The homeowners at 2134 constructed a side yard property wall with drainage holes that drain all of their run off water directly to our clients property at 2128 E 5th. As a result, our clients yard has been eroded to the point where we are bringing in a lot of dirt to construct their garage.

Did talk to the tenant of the house and no new work has been done for some time. The property has over 75% of the lot used for structures. The weep holes do go into the neighboring property and did observed the property and was not able to see where the dirt has been removed by the amount of water coming through the weep holes. There is a building being built and is approx. 3' up from the dirt grade. Will check records and meet with the building official. RV. |

Was directed to meet with Loren Makus the engineer for Stormwater. He did look at the plans and due to the age of the masonry wall being in placed, that there is nothing that can be done through the City of Tucson. If they want something done, that the issue needs to be address through the civil courts. The wall was shown being built on plans that were approved in 1966. At this time the case will be closed.
