THE COURT HAS A CHAIN LINK TYPE FENCING OVER 6'0". RESEARCH SHOWS THAT THE COURT AND GRADED ACCESS ROAD WAS BUILT WITHIN A "NATURAL UNDISTURBED OPEN SPACE"-NUOS AREA AS INDICATED ON THE SUBDIVISION PLAT MAP (S01-042). THE ADDED COURT CAN BE SEEN ON THE 2008 PICTOMETRY PHOTO, BUT NOT ON THE 2006 VERSION. PERMIT T08CM01799 WAS APPROVED FOR AN ADDITION BUT DID NOT INCLUDED THE ADDED COURT, FENCE OR LIGHTING, NOR INDICATE THE NUOS AREA ON THE SITE PLAN. ALSO PERMIT T08CM01799 DID NOT ALLOW FOR GRADING, AS A SEPARATE PERMIT WOULD BE NEEDED.
