01/31/2005 COMPL - REINSPECTION EGRIFFIN Violation With this memo The Tucson Fire Department wishes to request litigation against 1702 W 36th- Portofino Apartments for the following Tucson Fire Code violations: 1). TFC 311.2.1- Failure to provide security to a vacant premises. (Apt 1125) Photos 2). TFC 110.1.1- Failure to abate an unsafe condition that endangers human welfare. (Failure to remove broken shards glass where children are immediately and frequently playing and currently living in adjacent apartment-witnessed by Inspector Griffin) Photos of play toys adjacent to vacant apartment. Contacts: Oscar Melendez - Manager Supervisor (did not give number) Debbie Bernardi (primary contact)- Complex manager-520- 882-7368 History: 1-10-05, 0900 hrs: Complaint from TPD, of several vacant apartments at this complex, used as for drugs, violence, and burglary purposes. Officer Corrales, TPD. Photos 1-10-05, 0910 hrs: - Initial inspection discovered 5 vacant apartments (including 1125), used for described purposed. At this time I declared these vacant apartments as being unsafe and imminent hazard. A Written order and Precitation warning was given to immediately abate by 1600 same day. 1-10-04 1600 hrs- vacant apartments are secured (including 1125) by locking devices and security- extension given until next day at noon. 1-11-05: All 5 apartments secured. With reinspection on other noted violations to be conducted on 1-31-05 1-31-05 1000 hours: a reinspection on other hazards noted at initial inspection, discovered an unsecured vacant apt (1125), that had been noted at initial inspection on 1-10-05. Shards of glass and curious children were gathered around and inside apt. A verbal warning in Spanish and English was given to children to stay away. At that time I was informed by manager Ms Bernardi, that vacant apartment had been in this condition for 2 days. Management was given immediate written warning to abate by 1500 and verbally told of Fire Department intention to litigate. Recommendation was given for 24-hour, 7day a week security. Was told that idea was not affordable.
