Access is not immediate, and efforts to gain access would delay life saving and fire fighting efforts. Key Box is required to be obtained and maintained as per TFC, which states: SECTION 506 KEY BOXES 506.1 Where required. Where access to or within a structure or an area is restricted because of secured openings or where immediate access is necessary for life-saving or fire-fighting purposes, the fire code official is authorized to require a key box to be installed in an approved location. The key box shall be of an approved type and shall contain keys to gain necessary access as required by the fire code official. 506.2 Key box maintenance. The operator of the building shall immediately notify the fire code official and provide the new key when a lock is changed or rekeyed. The key to such lock shall be secured in the key box.

12/29/2004 INSP - FULL EGRIFFIN Approved 6). Currently there are 2 sets of flush bolts, with padlocks and flush bolts on the ENTRANCE side of each of the practice and studio rooms, along with double-sided deadbolts. Currently there is the potential for the need of a key to exit these practice rooms, and or, the flush bolts could be locked on the ENTRANCE side, essentially locking the occupants in the room. This is a violation of The Tucson Fire Code, which states: 1008.1.8 Door operations. Except as specifically permitted by this section egress doors shall be readily openable from the egress side without the use of a key or special knowledge or effort. For your information, the following TFC requirements for locks and latches where allowed is below: 1008.1.8.3 Locks and latches. Locks and latches shall be permitted to prevent operation of doors where any of the following exists: 1. Places of detention or restraint. 2. In buildings in occupancy Group A having an occupant load of 300 or less, Groups B, F, M and S, and in churches, the main exterior door or doors are permitted to be equipped with key-operated locking devices from the egress side provided: 2.1. The locking device is readily distinguishable as locked, 2.2. A readily visible durable sign is posted on the egress side on or adjacent to the door stating: THIS DOOR TO REMAIN UNLOCKED WHEN BUILDING IS OCCUPIED. The sign shall be in letters 1 inch (25mm)high on a contrasting background, 2.3. The use of the key-operated locking device is revokable by the fire code official for due cause. 3. Where egress doors are used in pairs, approved automatic flush bolts shall be permitted to be used, provided that the door leaf having the automatic flush bolts has no doorknob or surface-mounted hardware. 4. Doors from individual dwelling or sleeping units of Group R occupancies having an occupant load of 10 or less are permitted to be equipped with a night latch, dead bolt or security chain, provided such devices are openable from the inside without the use of a key or tool. In addition, TFC also states: 1008.1.8.4 Bolt locks. Manually operated flush bolts or surface bolts are not permitted. Exceptions: 1. On doors not required for egress in individual dwelling units or sleeping units. 2. Where a pair of doors serves a storage or equipment room, manually operated edge- or surface-mounted bolts are permitted on the inactive leaf. All unauthorized flush bolts and double-sided dead bolts shall be removed or approved through an appeals process.
12/29/2004 INSP - FULL EGRIFFIN Approved 5). Currently there are cigarettes being extinguished on the floor, carpet, and many burn marks in several rooms. This is a very dangerous practice and is endangering the entire building. This practice must cease. Further discarding of cigarettes on the floor could result in civil litigation. TFC states; 310.7 Burning objects. Lighted matches, cigarettes, cigars or other burning objects shall not be discarded in such a manner that could cause ignition of other combustible material.

Wall coverings: Many rooms have what appears to be a cellular or foam plastic type wall covering, permanently adhered to the entire or a great portion of the interior walls of a majority of the 100 plus individual sound studios or practice rooms. Currently it is unknown what the flame index or the smoke spread rating of this material is. The Tucson Fire Code section 806.1.2 states; 806.1.2 Foam plastics. Cellular or foam plastics shall not be used as interior finish or trim. Exceptions: Cellular or foam plastic materials shall be permitted on the basis of fire tests that substantiate their combustibility characteristics for the use intended under actual fire conditions. Several rooms have a black felt type wall coverings also. Information shall be furnished regarding this material, or material shall be removed. Currently this business does not have a Certificate of occupancy (C of O). Assuming that the C of O shall be issued for Storage (S) or Business (B) type occupancy. Class C rating would be required for all APPROVED wall coverings. Information on all wall coverings shall be submitted to TFD for review, or wall coverings shall be removed.
12/29/2004 INSP - FULL EGRIFFIN Approved 3). Certificate of Occupancy (C of O) shall be established or furnished to Tucson Fire Department. Currently usage of this building includes, but not limited to; storage of musical instruments, sound studios, and private residence. C of O shall reflect current usage. C of O shall be obtained from City of Tucson Development Services Division, 201 North Stone Blvd, 520-791-5550. The International Building Code (Tucson Building Code) Section 110 states; SECTION 110 CERTIFICATE OF OCCUPANCY 110.1 Use and occupancy. No building or structure shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made until the building official has issued a certificate of occupancy therefor as provided herein. Issuance of a certificate of occupancy shall not be construed as an approval of a violation of the provisions of this code or of other ordinances of the jurisdiction.

Fire alarm; An appeal dated 7-21-2000 to "fully remove the fire alarm" submitted by Mr. Francisco Gamez, was denied by Battalion Chief Dan Uthe (520-791-4502). Currently fire alarm system is still not operational, due to alarm activations without reset, and other indicators of trouble in the system showing on the fire alarm panel. All components of this fire shall be repaired and (or) replaced by an approved contractor. Test and inspection report shall be submitted to Tucson Fire Department. TFC 901.6.
