Each focus area contains specific goals, and each element contains specific policies. Plan Tucson includes the following stipulations for telecommunications facilities: LT28.4.10 Require telecommunications facilities be located, installed, and maintained to minimize visual impact and preserve views. Cabling and fiber optics should be installed underground where possible, and the visual impact of cellular towers should be a prime consideration in the City's acceptance and approval. LT28.4.11 Improve the appearance of above-ground utilities and structures and extend access to high-tech wireless communications facilities throughout the City. LT.28.3.14 Support environmentally sensitive design that protects the integrity of existing neighborhoods, complements adjacent land uses, and enhances the overall function and visual quality of the street, adjacent properties, and the community. Rincon/Southeast Subregional Plan The proposed tower is located within the Harrison/I-10 area of the Rincon/Southeast Subregional Plan. Map Detail #4 indicates that the property is within the Low Intensity Rural (LIR) land use category. According to the plan, the LIR designation is primarily for properties zoned RH (Rural Homestead). However, the subject site is zoned RX-1, which the plan identifies as a medium intensity rural zone. The Rincon/Southeast Subregional Plan has no specific policy direction regarding wireless communication facilities. Additionally, there are no subregional policies within the plan that are applicable to the proposed site. SURROUNDING ZONING AND USES: The site is zoned RX-1 Residence Zone along S Wilmot Rd, which is classified as an Arterial Street on the City of Tucson Major Streets and Routs Map. Properties to the north and east are also zoned RX-1. Properties to the south are zoned RH Rural Homestead, while those to the west are zoned I-2 Industrial. There is currently no address for the site, an address will need to be provided at the time of application. f Land uses include a microwave tower just to the north of the proposed telecommunications tower, which is on land owned by the State of Arizona. To the east is open land owned by the Arizona State Land Trust. To the south is a vacant parcel owned by the City of Tucson. To the west is the United States Penitentiary - Tucson, which sits on land owned by the US Federal Bureau of Prisons. ANALYSIS: This special exception is for a request to construct a wireless communication facility in the RX-1 Residence zone. The proposed facility includes a 75-foot monopole tower, backup generator on concrete pad, site support cabinet on a second concrete pad, an access easement, and a chain link security fence with barbed wire. The maximum tower height permitted in the RX-1 Zone is 50 feet. A Special Exception will need to be approved by Mayor and Council to install a 75-foot tower. The proposed tower would be located approximately 330-feet from an existing microwave tower on property owned by the State of Arizona. Section 4.9.4.I.3.a of the Unified Development Code (UDC) requires that no wireless communication transmitter, receptor, or other facility interfere with public safety communications. It is recommended that the applicant demonstrate that no interference will occur with the existing tower directly to the north of the proposed WCF, per the provisions of the UDC referenced above. Additionally, the applicant should demonstrate that co-location with this tower is not feasible, Per Section 4.9.4.I.3.d(3)g(c). The development plan shows a minimum 100-foot setback from all adjoining properties or right of way. This greater than the 75-foot setback that will be required (UDC Section 152.143). The access easement shown on the plan would need to be recorded as part of the approval process. The development plan shows co-locating opportunities below the top hat of the proposed tower, which addresses the negative proliferation requirement of the UDC. An RF Coverage Map will need to be provided with the application submittal, along with a statement that the applicant has investigated verticality in the area, and there are not suitable towers on which to co-locate. Additionally, the cabling inside of the monopole shown in the plan should remain, and no foot pegs should be showing to give the monopole a smoother look. Based on the standards listed above from both Plan Tucson, and the Rincon/Southeast Subregional Plan, No Plan Amendment is required.
