TRANSMITTAL: September 13, 2022

Provided a detail comment response letter with your submittal that clearly shows how you have addressed all comments with your next submittal.

This site is located in the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 – 9.

1. Provide a residential plot plan that meets the requirements found at: https://www.tucsonaz.gov/files/pdsd/forms/Residential_Plot_Plan_Requirements.pdf, to include the following:
a. Show the location of all utility lines on the plot plan.
b. Provide a dimension from the center line of the street to the face of curb and from the face of curb to the north property line. The distance from center line to the curb should be 15’-0” and from the curb to property line should be 10’-0”.
c. Indicated the zoning for this parcel and all adjacent parcels on the plot plan. The zoning should be R-1.
d. The property dimensions are not correct. Per Miramonte final plat found at: https://www.tucsonaz.gov/apps/maps-and-records/subdivisions/details/1131, the north/south property line is 135’ and the east/west is 75’.
e. Per Miramonte final plat mentioned above there is a 5’-0” utility easement that runs along the south and east property line. Show this easement on the plan and provide the recordation information.
f. Per Miramonte final plat mentioned above there is a 25’ Building setback line shown along the north property line. Show the setback line on the plan.
g. Provide a lot coverage calculation on the plot plan that meets the requirements of UDC Article 6.4.3 and the example shown on the Residential Plot Plan Requirements.

2. Based on aerial photos there is a detached structure located in the southwest corner of the site that appears sometime after 2018. Based on the dimensions provided on the plot plan this structure would not require a building permit, unless there are utilities to it, but would require a compliance review. Zoning was not able to find an approved plan for the compliance review of this structure. For this plan to be approved the structure shall either meet the required perimeter yard setbacks of the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A). Perimeter yard setbacks are based on a measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A or per UDC Article 6.6.2.D An accessory structure that exceeds the allowable height of a wall within a perimeter yard and is detached from a principal structure shall comply with the perimeter yard width standards of the principal structure, except that the accessory structure may be built to a parcel line with the consent of the adjoining or, when separated by an alley, adjacent property owner(s). To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s):
My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan.

Signature: _____________________________

Date: _________________________________
Also, this structure is not allowed within the 5’ utility easement mentioned above unless you can provide written approval from all utilities that have rights to the easement.
