This site is located in the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 – 9.
If the detached carport is to remain as shown on the plot plan the following comments apply:
1. This comment was not addressed. Per UDC Article 6.6.3.C Detached accessory buildings , including accessory dwelling units , are not permitted in the buildable area extending the full width of the lot between the principal building and the front street lot line. The proposed detached carport is considered a detached accessory structure and will require a Board of Adjustment for Variance if it is to remain as shown on the plan. Board of Adjustment application/requirements can be found at: https://www.tucsonaz.gov/files/pdsd/codes/Zoning_Administration_Application_BA_fillable.pdf. The Board of Adjustment is a separate submittal from this building plan and is submitted at: https://www.tucsonaz.gov/pdsd-filedrop, using the Submission Type “Zoning Administration”. 2. This comment was not addressed. Per UDC Article 6.4.5.C.1 the required front street perimeter yard setback is 20’ the greater of twenty (20) feet, or one and one-half (1 ½) the height of the proposed wall. Based on a wall height less than 9’-0” the require front street perimeter yard setback is 20’-0”, proposes setback is 3’-5”. The proposed front street perimeter yard setback can be reduced through the Board of Adjustment process mentioned above.

3. This comment was not addressed correctly. The setback waiver is required to be on the plot plan. Zoning acknowledges that a neighbor’s setback waiver was provided on the residential plot plan for the perimeter yard setback to the east property line. If the carport is going to go through the Board of Adjustment to remain as a detached accessory structure the reduced setback can be processed in the Board of Adjustment. If you wish to use the neighbor’s setback waiver the signature must be from one of the owners of the adjacent property. Provide documentation that clearly demonstrates the Olga Robles is an Officer with the Harking Properties, LLC, owners of the adjacent property, with your next submittal so that owner ship can be verified.
