FROM: PDSD Zoning Review

PROJECT:
T22CM03117
5409 E Willard St – R-1
Convert Garage to ADU (1st Review)

TRANSMITTAL: April 28, 2022
This site is located in the R-1 zone (UDC 4.7.1). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.5 - 9. 10.

Perimeter yard setbacks are based on a measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A. As dimensions from design grade were not provided Zoning has added 6” to all dimensions shown on the building elevations for the purpose of determining required perimeter yard setbacks.

The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A).
1. Based on a wall height of 9’-4” the required perimeter yard setback from the proposed ADU to the east property line is 6’-3”, propose setback is 5’-0”. As you are converting the garage, non-habitable space, to habitable spaces and the perimeter yard setback is not met a neighbor’s setback waiver is required prior to approval of this plan. To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s):
My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan.

Signature: _____________________________

Date: _________________________________

2. Based on the floor plan provided for the garage conversion and you are showing a full-size refrigerator this conversion is considered an accessory dwelling unit and impact fees will apply. Also the requirements of UDC Articles 4.9.7.B.6, 8, & 9 and 6.6.3, Clearly demonstrate on the plan that these articles are met or remove the full-size refrigerator and provide an under-the-counter refrigerator.

3. Base on aerial photos there has been an addition, called out as a “PATIO” on this plot plan that Zoning was not able to find permits for. Either provide approved permit documents or the porch addition will need to be permitted.
