This site is located in the R-1 zone (UDC 4.7.1). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.5 - 9. 10. Perimeter yard setbacks are based on a measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A. The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A). 1. Based on a wall height of 12’-0” the required perimeter yard setback from the proposed detached garage to the north & east property line is 8’-0”, proposed setback to the north property line is 3’-1” and to the east is 1’-0”. As a detached accessory structure, the reduced perimeter yard setbacks can be approved via a neighbor’s setback waiver, see UDC Article 6.6.2.D. To secure this waiver provide the text below for the neighbor to the north and east and have them sign & date. If you are unable to secure the waiver then a DDO would be required. 2. On the plan you state that you wish to use the DDO to exceed the allowed 50% of the gross floor area of the principal structure, UDC Article 6.6.3.E but the DDO cannot be used for this. A Board of adjustment for Variance will be needed to exceed the 50%. Setback waiver requirements: My Name is____________________ and I am the owner of the property located at_______________________.
