02/02/2022 STEVE SHIELDS ZONING REVIEW Reqs Change PDSD TRANSMITTAL

FROM: PDSD Zoning Review

PROJECT: T21CM00596
3552 S Chesin Dr – R-1
Bedroom & Family Room Addition (1st Review)

TRANSMITTAL DATE: February 2, 2022

This site is located in the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 – 9.

1. The setbacks listed for the front street and rear are not correct. Per UDC Article 6.4.5.C.1.a the front street perimeter yard setback is 20’-0” or 1-1/2 time the height of the exterior wall and per UDC TABLE 6.3-2.A: DIMENSIONAL STANDARDS FOR THE R-1, R-2, R-3, MH-1, & MH-2 ZONES, R-1 Zone, the rear is 6’-0” or 2/3 the height of the exterior wall.

2. Based on aerial photos there are two structures along the northwest property line. The northern one appears to be attached to the main dwelling and it does not meet perimeter yard setbacks. The southern one appears to be a detached accessory structure. As neither structure appears to meet perimeter yard setbacks a process will be required to permit these structures. If the northern structure is attached to the main dwelling and does not meet perimeter yard setbacks a Design Development Option (DDO), see below, will need to be submitted and approved to reduce the perimeter yard setback. Building code will need to be addressed for fire separation or fire ratings. The southern one if it does not meet perimeter yard setbacks will at a minimum require a neighbor’s setback waiver, see below. Depending on the size of this structure building code may apply.

A Design Development Option (DDO) must be submitted and approved to reduce the required setback,
DDO application and requirements can be found at: https://www.tucsonaz.gov/files/pdsd/forms/DDO_for_Setback_and_Height_UDC_8.11.20.pdf. A DDO is a separate submittal from the building plan and shall be submitted at: https://www.tucsonaz.gov/pdsd-filedrop, using the Submission Type “Zoning Administration”. If you have questions about the DDO application or process please contact Mark Castro at Mark.Castro@tucsonaz.gov.

Per UDC Article 6.6.2.D An accessory structure that exceeds the allowable height of a wall within a perimeter yard and is detached from a principal structure shall comply with the perimeter yard width standards of the principal structure, except that the accessory structure may be built to a parcel line with the consent of the adjoining or, when separated by an alley, adjacent property owner(s). To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s):
My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan.
