A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 – 9. 1. This comment was not addressed. If the owner enclosed this area a permit is required. Based on current aerial photos there is an area under the rear porch that has been enclosed. Zoning was not able to find approved permits for the addition. Show this addition on the plot plan and either provided approved permit documents with the next submitted or include it in this permit. 2. This comment was not addressed correctly. The required neighbors sign of for the property to the north was not provided and is required. As the property to the north is a Condominium Development the sign off must be done by the condominium association. If a sign off cannot be secured a Design Development Option (DDO) will need to be submitted and approved to reduce the setback. As no setback dimension was provided Zoning cannot provide the needed comments for submittal of a DDO. Based on Based on current aerial photos there is what appears to be a storage container along the north property line. Zoning was not able to find approved permits or compliance review for the shed. Show this container on the plan and provide perimeter yard setback dimensions to the north property line. It does not appear that this container meets the minimum 6’-0” required setback. At a minimum a neighbors setback waiver will be required. Per UDC Article 6.6.2.D An accessory structure that exceeds the allowable height of a wall within a perimeter yard and is detached from a principal structure shall comply with the perimeter yard width standards of the principal structure, except that the accessory structure may be built to a parcel line with the consent of the adjoining or, when separated by an alley, adjacent property owner(s). To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s): My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan. Signature: _____________________________ Date: _________________________________ 3. The proposed storage container is not allowed within the PUE unless you have written permission from all utilities that have rights to the easement. Provide the required written permission with the next submittal. 4. Remove the reference to 5’-0” PUE along the east and west property line as a PUE does not exist there.
