PROJECT:

766 W Calle Garcia. - R-1
Detached Shade Structure w/Solar. (1st Review)

TRANSMITTAL: January 31, 2022

This site is located in the R-1 zone (UDC 5.10.3). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.5 - 9.

1. Per UDC Article 6.6.3.B Detached accessory buildings are not permitted in the buildable area extending the full width of the lot between the principal building and the front street lot line. Based on locations of existing structures Calle Garcia would be considered the front street for this site. The proposed shade structure encroaches into the front yard and requires a Board of Adjustment for Variance. Board of Adjustment application/requirements can be found at: https://www.tucsonaz.gov/files/pdsd/codes/Zoning_Administration_Application_BA_fillable.pdf. The Board of Adjustment is a separate submittal from this building plan and is submitted at: https://www.tucsonaz.gov/pdsd-filedrop, using the Submission Type “Zoning Administration”. Contact of the Board of Adjustment is Mark Castro at Mark.Castro@tucsonaz.gov.

Per UDC Article 6.4.5.B.2 for structures like this the perimeter yard setbacks are measured from the post supporting the roof as long as there is no more than 2’ of roof overhang. Clearly show the post supporting the structure and provide the perimeter yard setbacks from the post to the property line.

2. Per UDC Article 6.4.5.C.1 1.Established Areas - a. Within established areas, the minimum required front street perimeter yard is 20 feet or one and one-half the height of the proposed wall (H), measured from the street property line , whichever is greater, up to a maximum of 90 feet, proposed front street perimeter yard setback is 16’-10”. The proposed reduced street perimeter yard setback can be processed within the required Board of Adjustment.

3. Per UDC Article 6.4.5.C.1 1.Established Areas - b. Where a lot abuts more than one street, the owner chooses which street lot line is the front lot line . From other than the front lot line, the street perimeter yard is ten feet. proposed side street perimeter yard setback is 8’-1”. The proposed reduced street perimeter yard setback can be processed within the required Board of Adjustment.

4. Provide a lot coverage calculation on the site plan that meets the requirements of UDC Article 6.4.3 and the example shown on the Residential Plot Plan Requirements found at: https://www.tucsonaz.gov/files/pdsd/forms/Residential_Plot_Plan_Requirements.pdf,

5. Per UDC Article 6.6.3.C Accessory structures shall not exceed 12 feet in height, unless attached to a principal structure. Provide fulling dimensioned elevations of the proposed shade structure so that height can be verified.

6. Based on current aerial photos there are two (2) detached sheds located where you call out “(E) STRUCTURE (TYP.)” that appear some time after 2019. Zoning was not able to find an approved compliance review or permits for these structures. As these structures do not meet side street perimeter yard setbacks they will need to be processed along with the required Board of Adjustment.
