COMMENTS:
1. Development must comply with the Administrative Manual Section 2-06 - Development Package.
2. The proposed use is food services with alcohol as an accessory use, which is permitted in the C-1 zone, use specific standards 4.9.4.V.1, .3, and 5-9, 4.9.4.C.3 and 4.9.13.O apply.
3. The cumulative expansion is greater than 25% and triggers full code compliance.
4. Per use-specific standard 4.9.4.V.9, since the food service establishment is located within 300 feet of a residential zone, excluding public right of way, the applicant is required to submit a mitigation plan to the PDSD Director what will be reviewed in accordance to Section 3.3.5 400' Notice Procedure.
5. To use shopping center parking calculations, food services cannot exceed 50% of the shopping center sq ft of gross floor area.
6. Per UDC, 7.4.8, restaurants require 1 short-term bicycle parking space per 2,000 sq ft of gross floor area, and 1 long-term bicycle parking space per 12,000 sq ft of gross floor area but with a minimum of 2 long-term bicycle parking spaces.
7. Improvements within the future right of way may require a MS&R Right of Way Use Modification Request.
8. Parking and the sidewalk towards the south are located on a separate parcel and would require a cross access agreement.
9. Per the Technical Standards Manual, 7-01.3, a continuous pedestrian circulation is required to connect all public access areas of development including the adjacent street.
10. The comments provided are preliminary and are not to be assumed as a complete review of the proposal. During the Development Package review process, a full review will be made by Zoning to assure compliance with the applicable UDC development criteria and Technical Standards.

7.6 Landscaping and Screening
The Unified Development Code (UDC) requires all new development or an expansion of greater than 25% of an existing development submit a landscape plan, UDC 7.6.2. Preparation of the landscape plan shall adhere to UDC 7.6.4. and Administrative Manual 2-10.

This project is considered a 100% expansion and will have to adhere to the current Unified Development Code for landscape and screening requirements.
