Multi-Family is an allowed use in the zone (UDC Table 4.8-2) subject to Use Specific Standard 4.9.7.B.6 1. Per UDC 3.3.3.G.2.c as you are adding a structure to a site a site plan, development package (DP), meeting the checklist for Minor Changes to a Commercial/Industrial Site is required to be submitted and approved prior to approve of this permit. The checklist can be found at: https://www.tucsonaz.gov/files/pdsd/forms/Minor_Changes_to_Commercial_Industrial_Sites_.pdf. The DP is separate submittal from the building permit and is submitted at: https://docs.tucsonaz.gov/Forms/tucsonpermitapp, using Submission Type “Site Review”. 2. Per UDC Article 6.6.3.C Within Residential Zones accessory structures shall not exceed 12 feet in height, unless attached to a principal structure. Per UDC Article 6.4.4.A Measurement of Building Height: Building height is the vertical distance measured from the design grade elevation to the highest point of a flat roof; to the deck line of a mansard roof; or to the middle (between the eave and ridge ) of the highest gable of a pitched or hipped roof. That all said the propose shade structure exceeds the allowed height of an accessory structure in the R-3 Zone. A Board of Adjustment for Variance is required for the shade structure as drawn. Board of Adjustment application/requirements can be found at: https://www.tucsonaz.gov/files/pdsd/codes/Zoning_Administration_Application_BA_fillable.pdf.
