Marijuana Dispensary use is allowed in the zone (Table 4.8-4) subject to Use Specific Standard 4.9.9.E.1. 1. The proposed dispensary exceeds the allowed 10,000 square footage per UDC Article 4.9.9.E.1.a. The resubmittal for this plan fails to demonstrate how this standard is met. The plans do not demonstrate how the proposed suites are two separate uses. 2. Clearly demonstrate on the plans how the requirements of UDC Article 4.9.9.E.1.I regarding odor mitigation are met. Provide a mitigation design performed by an Arizona registrant who has demonstrated proficiency through registration, education, technical knowledge, or experience to perform such work.
