COMMENTS: the following comments are relative to an application for a Design Development Option (DDO) (UDC 3.11.1).

This site is located in the R-1 zone (UDC 4.7.8). A single-family residence is permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9.

Perimeter yard setbacks are based on a measurement from design grade to the highest point of the wall, see Unified Development Code (UDC) Article 6.4.5.b & Figure
6.4.5-A.

The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A).

1. Based on a wall height of 10’-0” the required perimeter yard setback from the proposed carport to the east property line is 6’-8”, proposed is 6’-4”. A Design Development Option (DDO) will be required. DDO application and requirements can be found at: https://www.tucsonaz.gov/files/pdsd/forms/DDO_for_Setback_and_Height_UDC_8.11.20.pdf. A DDO is a separate submittal from the building plan and shall be submitted at: https://www.tucsonaz.gov/pdsd-filedrop, using the Submission Type “Zoning Administration”. If you have questions about the DDO application or process please contact Mark Castro at Mark.Castro@tucsonaz.gov.

2. This comment was not addressed. As you are converting non-habitable space, garage, to habitable space, studio, and the space does not meet perimeter yard setback either a neighbor’s setback waiver or a DDO must be processed for the reduced setback. A neighbor’s setback waiver can be accomplished by providing the following text on the plot plan and have the owner of the property to the east sign and date:

My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan
Signature: _____________________________
Date: _________________________________
