| 08/25/2021 | STEVE SHIELDS | ZONING | REVIEW | Reqs Change | ZONING REVIEW TRANSMITTAL FROM: PDSD Zoning Review PROJECT: T21CM06584 2570 E Ross Pl – R-1 Convert Garage to Studio & Add Carport (1st Review) TRANSMITTAL: August 25, 2021 COMMENTS: the following comments are relative to an application for a Design Development Option (DDO) (UDC 3.11.1). This site is located in the R-1 zone (UDC 4.7.8). A single-family residence is permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9. Perimeter yard setbacks are based on a measurement from design grade to the highest point of the wall, see Unified Development Code (UDC) Article 6.4.5.b & Figure 6.4.5-A. The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A). 1. As a wall height to the highest point of the parapet wall of the carport was not provided the required perimeter yard setback from the proposed carport to the east property line cannot be verified. It does appear that the height exceeds 9’-0” which would require a perimeter yard setback greater than the 6’-0” shown on the plan. It appears that a Design Development Option (DDO) will be required.DDO application and requirements can be found at: https://www.tucsonaz.gov/files/pdsd/forms/DDO_for_Setback_and_Height_UDC_8.11.20.pdf. A DDO is a separate submittal from the building plan and shall be submitted at: https://www.tucsonaz.gov/pdsd-filedrop, using the Submission Type “Zoning Administration”. If you have questions about the DDO application or process please contact Mark Castro at Mark.Castro@tucsonaz.gov. 2. As you are converting non-habitable space, garage, to habitable space, studio, and the space does not meet perimeter yard setback either a neighbor’s setback waiver or a DDO must be processed for the reduced setback. A neighbor’s setback waiver can be accomplished by providing the following text on the plot plan and have the owner of the property to the east sign and date: My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan Signature: _____________________________ Date: _________________________________ If you have any questions about this transmittal, please contact Elisa Hamblin or Elisa.Hamblin@tucsonaz.gov. |
