This site is located in the R-1 zone (UDC 4.7.1). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.5 - 9. 10. Provide a detailed comment response letter clearly stating how all Zoning Comments have been addressed with your next submittal. Perimeter yard setbacks are based on a measurement from design grade to the highest point of the wall, see Unified Development Code (UDC) Article 6.4.5.b & Figure 6.4.5-A. The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A). Per UDC Article 6.4.5.B.2 A vertical structural member(s) (i.e., post, column, dormer wall) supporting a roof extension from the principal structure is considered a wall for applying perimeter yard requirements. Or if a roof overhang exceeds 2’-0” the setback is measured from the allowed 2’-0” overhang, see UDC Article 6.4.5.D.1. Zoning acknowledges that a DDO has been submitted but until it is approved and the additional comments below have been addressed Zoning cannot approve the plans. 1. North Carport: Based on a wall height less than 9’-0” the required perimeter yard setback from the attached carport to the north property line is 6’-0”, as the overhang is proposed to be 3’-3’ the setback is measured from the allowed 2’-0” overhang therefore the proposed setback is 5’-0”. South Carport: Based on a wall height less than 9’-0” the required perimeter yard setback from the attached carport to the south property line is 6’-0”, as the overhang is proposed to be 0’-5’, the proposed setback is 1’-5”. A Design Development Option is required. DDO application and requirements can be found at: https://www.tucsonaz.gov/files/pdsd/forms/DDO_for_Setback_and_Height_UDC_8.11.20.pdf. A DDO is a separate submittal from the building plan and shall be submitted at: https://www.tucsonaz.gov/pdsd-filedrop, using the Submission Type “Zoning Administration”. Additional comments: 2. It appears that the north arrow is not shown correctly on the plot plan. 3. Based on current aerial photos there is some type of shade structure in the front yard that is not shown on the plot plan. It does not appear that these structures meet the required street perimeter yard setback of 20’-0” or 1-1/2 times the height of the structure, greater of the two. Show these structures on the plan and provide street perimeter yard setback dimensions. A DDO may be required. This letter reflects comments to be addressed. In order to facilitate a shorter back check time, please provide an updated complete plan set with a written response to each of the notated items indicating action taken. Do not cloud the changes made for comment revisions. SCOPE OF REVIEW: The scope of this plan review covers architectural, plumbing, mechanical, energy conservation and electrical. All code references are to the 2018 International Residential Code and 2018 International Energy Conservation Code. All features were checked only to the extent allowed by the submittals provided. All portions of this project are assumed to meet or will meet other departmental requirements, conditions and concerns before permit approval. GENERAL REQUIREMENTS: Sample plans are available at https://www.tucsonaz.gov/pdsd/residential-permits The construction plan set should be separated from supporting documents like tables, specifications and product ratings. Items built without permit may require alteration or improvement for achieving code compliance with the 2018 IRC, R105. Complete construction plans are required for processing a building permit. The plans should show necessary structural changes for achieving building code compliance for the two unpermitted carports and garage walls, 2018 IRC. The carports require Zoning approval through the DDO process because they were placed inside of the setback distance to the property line. Furthermore, if Zoning requirements are completed the structures must be (2018 IRC) Building Code compliant. Issues of concern follow: GENERAL COMMENTS: 1. Plans are required for the garage construction before the north carport options are considered. Dwelling windows may not open into a garage. And the dwelling wall also requires a fire rating greater than T1-11 type sheathing. 2. The carport roof may not extend to a point closer than 3 feet from the neighboring property line without fire rated protection in compliance with R302.1 (City of Tucson Amended). 3. A roof overhang may not extend closer than 24” to the neighboring property line. A roof projection extending between 2 and 3 foot requires not less than one-hour fire-resistive construction on the underside, R302.1 (City of Tucson Amended). 4. A solution could be the removal of the carport roof within 3’ of the property line. Or include a complete one-hour rated wall parallel with the property line that performs as a fire barrier. But this option may not work if the dwelling has windows within the wall separating the garage from the dwelling.
