5.4.2. APPLICABILITY

The MS&R standards apply to the following uses on property, any portion of which abuts or is adjacent to a street designated on the City’s or County’s MS&R Plan:

A. New structures;

B. Changes of use, including new structures occurring on vacant land;

C. Uses of land or structures legally existing as of June 27, 1988, that are expanded in floor area, lot coverage, parking, seating capacity, or any other expansion of use, as listed below. Exception. An expansion of off-street parking for a nonconforming existing use that increases the number of spaces to the minimum required by the UDC for that use is exempt from counting toward the 25% expansion: (See Figure 5.4-A.)

1. If the expansion is less than 25%, the MS&R applies to the proposed expansion. The remainder of the use or structure shall be governed by provisions in force at the time of initial approval for the use or structure;

2. If the expansion is 25% or more, the MS&R applies to the proposed expansion and to the parking and landscaping standards that apply to the overall development; or,

3. Expansions that occur after the effective date of the MS&R shall be cumulated in determining the 25% expansion.

If applicable: Show compliance with landscaping and screening requirements by locations, material descriptions, and dimensions. Specific plant or hardscape material shall be detailed on a landscape plan. A detailed landscape plan is required. In accordance with Section 2-10.0.0, Landscape Plan Requirements.

1. An old, fragile 2" galvanized steel water main runs north and south on the west side of these parcels, and ¾" and 1" service lines from this old, fragile main serve these four parcels. Care will need to be taken during the construction of this new addition to avoid damaging this old, fragile 2" water line, and no additional connections will be allowed to this 2" line.

2. APNs 120-07-4650 and 120-07-460 are also served by 2" water service lines connected to the 8" PVC line (PN 245-2001) in 6th Avenue. If additional water services are needed for this project, they will need to be connected to this 8" PVC line.

3. Tucson Water also has a CIP project in this area, that may affect this development. The name of this project is W901 -6th AVENUE FROM AJO WAY TO PENNSYLVANIA. I have no other information about this project. For further information about this CIP project, please contact Ms. Monica Acuna, Tucson Water's Project Manager at 520-837-3126.

COMMENTS:
1. Development must comply with the Administrative Manual Section 2-06 - Development Package.
2. The proposal is to expand the existing business use. Additional information is needed regarding the existing use and the proposed expansion. Possible uses include Perishable Good Manufacturing (not permitted in a C-2 zone) or Food and Beverage Wholesaling (permitted in the C-2 zone subject to 4.9.13.P.). Perishable Goods Manufacturing may be permitted as an accessory use under certain conditions. See definitions below.
UDC Article 11.2.5.G. Perishable Goods Manufacturing - The processing and packaging of food products and other goods that are susceptible to spoilage or decay. Typical uses include meat packing operations, breweries and wineries, canneries, and bottling plants.
UDC Article 11.3.12.C. Food and Beverage Wholesaling - The selling of food or beverage products to other businesses. Typical uses include produce companies and beverage distributors.
3. As a more than 25% expansion, the site will need to meet full compliance for landscaping, parking, pedestrian access and other development standards. As described in previous comment, additional information is needed to determine compliance with development standards. Parking, setbacks and ped access general appear to be met.
4. A lot combination processed with Pima County will be required.
5. The comments provided are preliminary and are not to be assumed as a complete review of the proposal. During the Development Package review process, a full review will be made by Zoning to assure compliance with the applicable UDC development criteria and Technical Standards.
