I have reviewed the CDRC Pre-Submittal T20PRE0153- 865 E University Blvd.
- Gentle Ben's expansion submitted July 2020 for the purpose of determining its
conformance with the Submittal Requirements of the IID. I have checked the
submittal against the Pre-Submittal Requirements in the UDC Article 5.12.
Submittal Requirements Status
1. Identify proposal and why review is required. Complete
(land split, minor subdivision, major subdivision, (on Site Plan - as
compliance with HDZ, change of existing extension of
development plan, new development plan, condition premises)
of annexation or rezoning)
2. Identify any existing case numbers N/A
associated with the property. (Rezoning,
Subdivisions, Board of Adjustment, etc.) Provide
supporting documentation, rezoning conditions, etc.
3. Provide a copy of existing approved Site Existing Site Plan
Plan, Development Plan/Package or Tentative Plat Provided
for re-subdivisions.
4. If new plan, place a north arrow on it with Complete

COMMENTS:
1. Development must comply with the Administrative Manual Section 2-06 - Development Package.
2. The proposal is for temporary and permanent expansion of outdoor seating at an existing Food Service and Alcoholic Beverage Service use. The use is permitted in the UHC-3 zone.
3. The use previously extended and remodeled the building and outdoor patio in 2018 under permit T18SA00235. The prior approval should have changed the zoning designation to UHC-3.
4. A development package is required for all patio areas on private property. For the seating on City property (right-of-way), please work with the City’s real estate staff by contacting John.Cahill@tucsonaz.gov.
5. The proposed permanent patio expansion will require a new application and review through the City’s Main Gate Overlay process. Please discuss with Maria.Gayosso@tucsonaz.gov. Development package submittal and first round review comments are required prior to acceptance of the Main Gate application.
6. For the temporary expansion of seating, please work with the City’s Zoning Administrator Russlyn.Wells@tucsonaz.gov.
7. The comments provided are preliminary and are not to be assumed as a complete review of the proposal. During the Development Package review process, a full review will be made by Zoning to assure compliance with the applicable UDC development criteria and Technical Standards.
