Uses of land or structures legally existing as of June 27, 1988, that are expanded in floor area, lot coverage, parking, seating capacity, or any other expansion of use, as listed below. Exception. An expansion of off-street parking for a nonconforming existing use that increases the number of spaces to the minimum required by the UDC for that use is exempt from counting toward the 25% expansion: (See Figure 5.4-A.) 1. If the expansion is less than 25%, the MS&R applies to the proposed expansion. The remainder of the use or structure shall be governed by provisions in force at the time of initial approval for the use or structure; 2. If the expansion is 25% or more, the MS&R applies to the proposed expansion and to the parking and landscaping standards that apply to the overall development; or, 3. Expansions that occur after the effective date of the MS&R shall be cumulated in determining the 25% expansion. If applicable: Show compliance with landscaping and screening requirements by locations, material descriptions, and dimensions. Specific plant or hardscape material shall be detailed on a landscape plan. A detailed landscape plan is required. In accordance with Section 2-10.0.0, Landscape Plan Requirements. |

Development must comply with the Administrative Manual Section 2-06 - Development Package. 2. The proposed use is Automotive Service and Repair, Minor, which is permitted in the MU through a Zoning Examiner Special Exception procedure and is subject to use-specific standards 4.9.5.C.6. The proposed secondary use is Parking, which is also permitted in the MU zone through a Zoning Examiner Special Exception procedure and is subject to use-specific standards 4.9.5.C.6. 3. As the two sites are separated by a right-of-way, they cannot be considered a single site. Development on each site will require its own development package. Whichever site is used for building would likely require the other site to be used for parking. This would require an offsite parking agreement. See UDC Article 7.4.6.B.1. 4. If the proposed building is constructed on the Fairview site, it appears to be more than a 25% expansion. As such, full code compliance will be triggered for the entire site, including landscaping, pedestrian access, trash enclosure, etc. 5. If the proposed building is constructed on the Wegner site, the major constraints will be the street setback, landscaping, and trash requirements, assuming the parking will be handled on the Fairview site. 6. Parking will be calculated at a ratio of 1 space per 300 sq. ft. More information is needed to provide an accurate calculation. 7. During the Development Package review process, a full review will be made by Zoning to assure compliance with the applicable UDC development criteria and Technical Standards.
