COMMENTS: the following comments are relative to an application for a Design Development Option (DDO) (UDC 3.11.1).

This site is located in the R-3 zone (UDC 4.7.12). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2), subject to Use Specific Standard 4.9.7.B.6.

Perimeter yard setbacks are based on a wall height as measured from design grade to the highest point of the wall, see UDC Article 6.4.5.B and Figure 6.4.5-A.

1. This comment was not addressed. As this accessory structure is showing as a “PROPOSED ATTACHED ACCESSORY BUILIDNG” and based on the plans it is attached, the neighbor setback waiver cannot reduce the perimeter yard setbacks A Design Development Option must be submitted and approved. The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A). Based on a wall height of 12’-9” the required perimeter yard setback from the proposed studio addition to the north is 8’-6”, proposed setback to the north and east property line is 1’-0”. Based on a wall height of 10’-9” the required perimeter yard setback from the proposed studio addition to the east is 7’-2”, proposed setback to the north and east property line is 1’-0”.
