| 08/26/2020 | STEVE SHIELDS | ZONING | REVIEW | Reqs Change | PDSD TRANSMITTAL FROM: Steve Shields Section Manager PROJECT: T20CM02217 2575 N Cherry Ave New Detached Garage Residential (1st Review) TRANSMITTAL DATE: August 26, 2020 This site is located in the R-1/R-2 zone (UDC 4.7.9). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.5 - 9. 1. Per Unified Development Code (UDC) Article 6.6.3.B Detached accessory buildings are not permitted in the buildable area extending the full width of the lot between the principal building and the front street lot line, except for terraces and steps not over three feet high above the natural grade, paved areas, and fences or walls. The front yard is defined by the setback requirements in UDC Article 6.4.5.C.1 and for a street to qualify as the front yard the primary residence must be setback 20' from the street property line. Based on the plot plan provided the setback off of Cherry Ave. to the primary residence is 14' and does not qualify as the front street, therefore Copper Street would be considered the front street and the accessory structure, new garage, is not allowed in the area between the principal building and the front street lot line. A Board of Adjustment for Variance is required. The Board of Adjustment for Variance application can be found at: https://www.tucsonaz.gov/files/pdsd/codes/Zoning_Administration_Application_BA_fillable.pdf The variance must be approved prior to the building permit.
