ANALYSIS: The applicant is proposing a special exception on a C-1 zoned lot to allow for a wireless communication land use. The proposed project consists of two rooftop stealth cell sites with eight foot antennas behind a ten foot stealth façade on the northwest and southwest corners, and with equipment located on the ground on the south side of the Century Link building. The proposed project does not meet all use specific standards for a wireless communication land use in a C-1 zoned lot, and requires a Zoning Examiner Special Exception Procedure. A roof mounted antenna is limited to being six feet above the building (U.D.C. policy 4.9.I.4.a.3), and the proposed project shows an antenna height of eight feet above the building. Wireless communication towers must also be setback a minimum of 500 feet from non-industrially zoned property (U.D.C. policy 4.9.I.5.c.3), and the proposed site is directly adjacent to a residential zone, single-family residences, to the west. The proposed project does meet all use specific standards for U.D.C. policy 4.9.I.6, such as the antennas being under 50 feet, and therefore requires approval as a special exception in accordance with Section 3.4.3, Zoning Examiner Special Exception Procedure. Plan Tucson requires that wireless communication facilities be located, installed, and maintained to minimize visual impact and preserve views. The site plan shows the antennas are hidden behind a screen, but their location on the corners of the building raises concern regarding minimizing visual impacts. The site is within the bounds of the Alvernon-Broadway Area Plan and the Miramonte Neighborhood Plan. While these Plans provide no specific policy direction for cell site proposals, the Miramonte Neighborhood Plan does include a policy that calls for mitigating clutter and unattractive visual elements. Both Plans make reference to creating attractive transitions between residential and commercial uses. The location of this site is in an area identified for commercial uses in the Alvernon-Broadway conceptual land use map. APPLICABLE PLAN POLICIES: Plan Tucson contains a variety of elements that are categories in four focus areas, including the Social Environment, the Economic Environment, the Natural Environment, and the Built Environment. Each focus area contains specific goals and each element contains specific policies. The Future Growth Scenario Map illustrates different building blocks within the city that have specific policies to promote future growth opportunities. The proposed development lies within the Existing Neighborhoods building block of the Future Growth Scenario Map. LT28.1.2 Require telecommunications facilities be located, installed, and maintained to minimize visual impact and preserve views. Cabling and fiber optics should be installed underground where possible, and the visual impact of cellular towers should be a prime consideration in the City's acceptance and approval. LT28.1.3 Improve the appearance of above-ground utilities and structures and extend access to high-tech wireless communications facilities throughout the city. LT28.2.12 Support environmentally sensitive design that protects the integrity of existing neighborhoods, complements adjacent land uses, and enhances the overall function and visual quality of the street, adjacent properties, and the community. LT28.2.14 Protect established residential neighborhoods by supporting compatible development, which may include other residential, mixed-use infill and appropriate nonresidential uses. The goal of the Miramonte Neighborhood Plan (MNP) is to provide land use policy direction and design guidelines for development within the Plan boundaries. Policy 4.2: Make the Neighborhood more attractive by mitigating clutter and unattractive visual elements. The goal of the Alvernon-Broadway Area Plan (ABAP) is to provide land use policy direction and design guidelines for development within the Plan boundaries. Nonresidential Policy 2: Limit new office and commercial uses and redevelopment of existing uses to the locations shown on the Conceptual Land Use Map when all of the following criteria are met. C. Screening and buffering for adjacent residential uses can be provided on-site. The Conceptual Land Use Maps within both the ABAP and the MNP are intended to provide criteria for determining where development is appropriate. The proposed project area is identified as "Office, Commercial, and High-Density Residential" in both area plans. |
