Benson Highway as regulated by City of Tucson Ordinance No. 10850, 11199, and 11346. Staff has researched the subject location to determine compliance with UDC and found that this site is not in compliance with UDC Sec. 4.9.9.E.1.c, 4.9.9.E.g and 3.3.3.G.2.c as excerpted below: 4.9.9.E.1.c - A medical marijuana dispensary shall be located in a permanent building and shall not be located in a trailer, cargo container, mobile or modular unit, mobile home, recreational vehicle, or other motor vehicle. "Building" shall have the same meaning provided in Section 11.4.3, Definitions-B. A mobile building has been located in the southwest corner of the fenced area without permits. 4.9.9.E.1.g - A medical marijuana dispensary shall not have outdoor seating areas. Outdoor seating has been provided along the west site of the building under shade structures without permits. 3.3.3.G.2.c - A site plan is required for the following types of development: Existing development undergoing a change of use, building or structure additions, and/or a reconfiguration of an area outside a building. The vehicle parking has been expanded to the northeast on the site into an unimproved area, graveled and striped. A mobile building and outdoor seating added to the site. No permits approved. |
