APPROVED PLAN AMENDMENT TO SOUTH PANTANO AREA PLAN (SPAP) APPLICABLE PLAN POLICIES: Plan Tucson calls to evaluate industrial proposals on a case-by-case basis and site specific basis. Plan Tucson also supports environmentally sensitive design that protects the integrity of existing neighborhoods and complements adjacent land uses. South Pantano Area Plan (SPAP) Industrial policies call to ensure the availability of adequate services and the proper siting of industrial developments. The subject site is within Subarea 6 of the SPAP. A Plan Amendment was approved via resolution #23037 on June 4, 2019 to allow Industrial use as an interim use to rebuild and stabilize the soil at a closed 55-acre sand and gravel pit to stabilize conditions so that the future Park Industrial use specified can be realized. ANALYSIS The proposed land use is for an inert materials landfill and salvaging and recycling use (outdoor materials crushing for sale & re-use, green waste/mulch production) is allowed by the recent plan amendment. Support for the PAD rezoning will be based in part on the design of the PAD addressing the following things brought up at Mayor & Council meeting for the Plan Amendment. A. Traffic congestion (stacking) is minimized/mitigated to allow continuous flow of traffic on Harrison's two-lane road. B. Specific types of salvaging and recycling operations to be allowed. The material used to fill the hole will be monitored and restricted to only that which is allowed. No other debris shall be disposed of on that property, subject to fines and penalties. C. Odor and air quality associated with types of salvaging and recycling operations to be controlled. D. Noise shall be minimized as much as possible E. All debris shall be kept onsite. Any debris that falls outside of the property shall be removed by the owner/workers at the site. F. Hours of operation including, but not limited to, access control hours and frequency of crushing operations shall be clearly defined and conform to normal business hours so as not to disturb the people and animals currently living in the area. G. Grinding activities shall be restricted to published hours of operation. H. Landscaping shall be planted to screen the project, with the use of drought tolerant vegetation. I. Setback distance shall be defined of operation landfill, salvaging, recycling, and crushing operations. J. Fire potential associated with types of salvaging and recycling operations must be clearly stated. K. Appropriate areas for storage, sorting, and bailing operations. L. Specify a time limit for the proposed interim Industrial (I-2) zone. M. Address any potential interference with bicycle path that runs past site. N. Address any potential truck stacking issues for weighing at the entrance of the landfill. Next Steps: Begin to draft PAD document. Once a draft PAD document is written you will submit for a Pre-PAD review, which is a 20 working day review. It may need to be changed and submitted again for another review. Conditional approval of the PAD after Pre-PAD review is required prior to holding the neighborhood meeting. The total fee for rezoning 55.5 acres to PAD is $35,338.60, and half ($17,669.30) is due at Pre-PAD review, and the other half is due at the final rezoning application submittal. |
