Development must comply with the Administrative Manual Section 2-06 - Development Package. 2. The proposal is for an expansion of building footprint to the front (east) of an existing food service use. The building expansion will cover approximately 276 sq. ft. of an already approved patio area which is 495 sq. ft. in size. See case details below. a. In 2008, a certificate of occupancy permit (T08OT0053) approved a main building, outdoor seating and a storage building on site. b. In 2018, a development package (DP18-0137) approved the relocation of the existing outdoor seating from the rear (west) to the front (east) of the building. The existing seating totaled 530 sq. ft. and the new seating totaled 495 sq. ft. 3. As the building addition is planned for an already approved use area, it will not constitute an expansion of use. Please note, the 276 sq. ft. of building addition will be subtracted from the 495 sq. ft. of outdoor seating area. The remaining 219 sq. ft. is the maximum area that is allowed for outdoor seating. Ensure the submitted development package correctly notates the allowed outdoor seating area. 4. From the preliminary submittal it appears the building addition will impede the current accessible route to the building. Ensure the submitted development package includes an accessible route. 5. The required building setback from Park Av is 21' or the height of the structure, as measured from the back of the curb. Ensure the submitted development package includes the appropriate setback information. 6. The comments provided are preliminary and are not to be assumed as a complete review of the proposal. During the Development Package review process, a full review will be made by Zoning to assure compliance with the applicable UDC development criteria and Technical Standards.
