Planning and Development Services Department (PDSD) has reviewed the materials provided with the application for a proposed Medical Marijuana Designated Caregiver Cultivation Location at 1906 E. 18th Street as regulated by City of Tucson Ordinance No. 10850, 11199, and 11346. Staff has researched the subject location to determine compliance with Unified Development Code (UDC) Sec. 4.9.9.E and found that this site is not in compliance with UDC Sec. 4.9.9.E.3.a & 4.9.9.E.2.i as excerpted below:

UDC Sec. 4.9.9.E.3.a, All conditions and restrictions for medical marijuana dispensary off-site cultivation locations apply except that the designated caregiver cultivation location cultivation area is limited to a total 250 square feet maximum, including any storage areas.
UDC Sec. 4.9.9.E.2.i, In the I-1 and I-2 zones, a medical marijuana dispensary off-site cultivation location shall be setback a minimum of 500 feet from a K-12 public, private, or charter school, measured in a straight and direct horizontal line from the closest exterior or applicable interior suite wall of the medical marijuana off-site cultivation location to the closest property line of a school.

The Fred G. Acosta Job Corps Center, 901 S. Campbell Ave. is located on tax parcel 129-01-1060. This center provides high school classes. The property line of tax parcel 129-01-1060 is less than 500 feet from the proposed medical marijuana designated caregiver cultivation location. Based on this information, the proposed location is not in compliance with the requirements of the City of Tucson Unified Development Code. Planning and Development Services Department (PDSD) has reviewed the materials provided with the application for a proposed Medical Marijuana Designated Caregiver Cultivation Location at 1906 E. 18th Street as regulated by City of Tucson Ordinance No. 10850, 11199, and 11346. Based on the information you have provided the subject site is in general compliance with Ordinance No. 10850, 11199, and 11346.

This letter will provide authorization for proceeding with all required permits necessary to comply with City regulations and will vest the subject site as a Medical Marijuana Designated Caregiver Cultivation Location for City of Tucson purposes for one (1) year from the date of this letter. The subject site will be considered to be fully vested upon issuance of an Arizona Department of Health Services (ADHS) Certification and issuance of applicable City of Tucson building permits.

Zoning compliance is specifically contingent upon ADHS approval of your application.

Conditions:
1. Submittal and approval of an odor mitigation plan including additional HVAC controls and/or air scrubbers is required. This plan will need to be submitted with the Tenant Improvement plans.
2. Provide a copy of this letter with you Tenant Improvement plans.
3. Provide a copy of the survey that demonstrates that required setbacks are met to the Fred G. Acosta Job Corps Center, 901 S. Campbell Ave.
