COMMENTS: The following comments are for the purpose of applying for a variance before the Board of Adjustment (UDC Section 3.10.1).

This site is located in the R-1 zone (UDC 4.7.9). Multi-family residential is a permitted use in this zone (Table 4.8-2). ). See Use Specific Standards 4.9.7.B.6, .9 & .10.

The maximum building height for accessory structures shall not exceed 12 feet in height, unless attached to a principal structure. If attached to the principal structure, maximum height permitted shall be the same as for the principal structure (UDC 6.6.3.C)

The applicant is proposing to construct a 12'-6" tall garage attached to detached accessory structures. A variance is required to allow the garage exceed the maximum height for accessory structures from 12' to 12'-6".

The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure's wall facing each interior property line (Table 6.3-2.A).

Based on a wall height of 12'-6" the required perimeter yard setback to the north and east lot line is 8'-3". The applicant is proposing 2'to the north and 6' to the east.

The applicant is proposing to construct a patio cover attached to the studio, 3' from the west lot line. A variance is required to allow a reduced setback from 6' to 3'.

The total gross floor area (gfa) of all accessory structures shall not exceed 50% of the gfa of the principal structure. Accessory structures less than 200 square feet gfa are exempt from this requirement. (UDC 6.6.3.D)

The total gfa of the residence is approximately 1440 sqft. The combined total gfa of the studio and garage is 1165 sqft which exceeds the 50% maximum.
