COMMENTS: the following comments are relative to an application for Historic Review (UDC 5.8.8).

This site is located in the HR-3 zone (UDC 4.7.9). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.6.

When a residential use is adjacent to a non-residential zone, the minimum setback is the greater of ten (10) feet, or three-quarters (3/4) the height of the structure's wall facing each interior property line (Table 6.3-2.A). To the north property line, the required setback is 10'9", the proposed setback is 4'0". To the south property line, the required setback is 9'9", the proposed setback is 8'9". To the east property line, the required setback is 11', the proposed setback is 4'3".

The minimum setback to the front street perimeter property line is the greater of twenty (20) feet, or one and one-half (1 ½) the height of the proposed wall (UDC 6.4.5.C.1.a). The existing historic structure on site is located 10'4" from the street property line.

Additionally, the applicant is proposing a pool on the property (T19BU00029)

COMMENTS: the following comments are relative to an application for Variance Review (UCD 3.10).

The maximum height of an accessory structure is 12' per UDC Article 6.6.3.C. The proposed height is 17'9".

The maximum gross floor area of an accessory structure shall not exceed 50% of the principal structure per UDC Article 6.6.3.D. The proposed gross floor area of the accessory structure is 1469 sf and principal structure is 1054 sf.

Detached accessory buildings are not permitted in the buildable area extending the full width of the lot between the principal building and the front street lot line per UDC Article 6.6.3.B. The existing historic structure fronting on Main Av is located in the buildable area between the principal building and the front street lot line.
