COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.


1. COMMENT: Per the submitted site plan for review, a shade structure is proposed along the south boundary of the well site. The property is zoned RX-1. All structures in this zone must meet the minimum building setback of 20 feet from the interior property lines. The proposed shade structure identified with keynote F, does not meet the minimum setback distance of 20 feet.

The building setback along the street frontage is based on the greatest of 20 feet or 1.5 x the height of the structure adjacent to the street property line from the new structure over the new generator. It is not known what the height of the structure over the generator is due to lack of dimensions and probably will not be determined until after installation of the generator (per the notes on the plan).

In addition, a Distribution system is not allowed with the RX-1 zone making the existing use on this site a non-conforming use. It is clear that the well site has been here for a very long time and most if not all of the well sites appear to be in residential zones. While the Unified Development Code does allow a Distribution System use within the Commercial and Industrial zones, the use is not allowed in residential zones at all or must be approved through a special exception review and approval process.

In the past due to the code restrictions on this use in specific zones the Water Department has requested a waiver of the zoning code requirements. If a City Manger waiver is proposed the request shall be made to PDSD staff through the Zoning Administrator (Russlyn Wells).

2. COMMENT: At this time the Permit application T18CM00743 cannot be approved by the Zoning review section.
