Mark Mayer Billboard Review Committee On the basis of the following, permit application is denied. 1. The Stipulation requires a permit for replacement of an electric meter and electrical wiring and no such permit was obtained prior to the respective removals of same (Subparagraph 10.5 and Exhibit 9, Section 2). 2. The meter and wiring were removed two years prior to the submittal of an application to install a new meter and reinstall the removed wiring. As such, at the time of application submittal there was no existing meter or wiring to replace. 3. If a permit had been obtained prior to meter and wiring removal, the existing meter and wiring could have been removed and replaced (or reinstalled) at any time during the pendency of the permit (180 days). Given, however, that two years had lapsed between meter and wiring removal and application to replace or reinstall same, the permit would have long since expired and electrical service deemed terminated 4. The applicant’s January 15, 2019 response letter does not address the length of time that the meter and wire were removed. 5. Due to the length of time the meter has been removed, the utility company itself has deemed this to be an entirely new service subject to current standards (per applicant’s submitted plan sheets). 6. Arizona law disfavors the continuation of nonconforming uses and only protects existing property (application of which is provided for in Paragraph 20 of the Stipulation). FIN. |
