The use falls under UDC TABLE 4.8-4: PERMITTED USES - COMMERCIAL AND MIXED USE ZONES - Permitted as Special Exception Use, [1] Mayor and Council Special Exception Procedure, Section 3.4.4. The following Use Specific Standards apply: 4.9.4.I.2, .3 & .7.

Background: This proposal is for a special exception use in the C-3 commercial zone to allow a 46 foot tall wireless communication facility (WCF) a stealth design monopole collocated on a Tucson Electric Power (T.E.P.) pole. Height of T.E.P. pole will be increased ten feet to allow a height of forty six feet. The proposed WCF stealth design includes a cylindrical canister that surrounds and conceals three sectors and six antennas. The associated ground equipment will be adjacent to the WCF pole on a 18' X 15' square foot area previously occupied by two parking spaces. The WCF is proposed at 2 W. University Boulevard, at the northwest corner of University Boulevard and Stone Avenue, approximately 65 feet north of the University Boulevard right-of-way and within an on-site private access/utility easement, also identified on City map as N. Ash Avenue. The eight foot wide cylindrical concealment canister will be painted to match the WCF pole. The cylindrical canister will conceal three sectors with two antennas per sector for a total of six antennas on the WCF. The proposed ground lease area will replace two parking spaces and be enclosed by an eight foot tall CMU wall and contain three equipment cabinets. The service of a back-up generator is excluded from the WCF proposal.

According to the Major Streets and Routes Plan, University Boulevard is designated as a collector street.

Surrounding Zoning and Land Uses: The special exception site for a wireless communication facility is proposed west of Stone Avenue and approximately sixty-five (65) feet north of University Boulevard. Parcels located south across University Boulevard and north across 2nd Avenue are developed with multi-family high density residential land use in the C-3 commercial zone; to the east across Stone Avenue are commercial developments in the C-3 commercial zone, to the west is the Dunbar Springs Neighborhood, a Historic District developed with single family single-story residential homes in the R-3 zone, a high density residential zone, and in the C-1 commercial zone. The nearest residential zone is located northwest approximately 65 feet from the proposed WCF site. The nearest single-family residential unit is approximately 115 feet west of the proposed WCF site.

Rezoning Presubmittal Meeting: The applicant attended a presubmittal conference meeting on March 1, 2017. Meetings included discussion of various stealth designs and visual mitigation of the proposed WCF, with multiple sites in the immediate vicinity considered and the final site as proposed on this request is being considered on private property. The proposed WCF site does not meet the required setback from residentially zoned property and requires a legislative procedure Special Exception needing Mayor and Council approval. Applicant was encouraged to provide information as to why this location was needed. Per the applicant, this request is based on wireless communication needs to improve customer service.

Neighborhood Meeting: Applicant has provided the required neighborhood meeting material: mailing notification, copy of labels, notice letter, meeting summary, and sign-in sheet. The applicant held various meetings with the neighborhood, the following are meeting dates:
1. November 16, 2015, on site at 5:00 p.m. and a same day follow up meeting at the Dunbar School Center at 8:00 p.m.;
2. March 24, 2016, at the Whistle Stop at 127 W. 5th Street;
3. December 19, 2016 as part of the Dunbar Spring Neighborhood meeting; and,
4. Final and official neighborhood meeting held on June 27, 2017.

The applicant has provided a synopses of area resident's feedback from these various meeting and stated the following:

Citizen Feedback - We have received extensive citizen feedback on this site. We collected comments cards at the neighborhood meeting held on March 24, 2016 at the whistle Stop. Some residents do not want the site to be built, however I did receive several comments from neighbors that want better coverage.

Applicant offers the following chronical:

The applicant has changed the design of the site several times to accommodate the request of the neighbors. The design changed from monopalm to a steel pole. As suggested by the neighborhood, they engaged Troy Neiman for design concept, none of the ideas satisfied the neighborhood. As proposed, when entering the neighborhood on University Boulevard, the WCF site will be on an existing Tucson Electric Power Company pole that is shielded from view by the apartment complex. In addition, the applicant is proposing to camouflage the antennas with a cylindrical metal cover. The proposed WCF height has be reduced from 60 feet to 46 feet. Verizon considered three other sites in the area, 919 N. Stone Avenue, 7 E. University Boulevard, 33 W. University Boulevard and the proposed special exception site for a WCF at 2 W. University Boulevard.

Land Use Policies: Plan Tucson provides land use guidance for this site. In general, the Plan supports the requested use when visual impacts, setbacks, and landscaping buffering elements are addressed.

The proposed site for the wireless communication facility is within a "mixed-use center," as identified by Plan Tucson. A mixed-use center provides a higher-intensity mix of jobs, services, and housing along major streets. The businesses and residences within these corridors will be served by a mix of high-frequency transit options, as well as pedestrian and bicycle facilities. In particular to wireless communication facility, Plan Tucson provides direction and support in Chapter 3 - The Built Environment, under Guidelines LT28.1.2, LT28.1.3 which state telecommunication facilities be installed and maintained to minimize visual impact and preserve views and to improve the appearance of above ground utilities and structures and extend access to high-tech wireless communication facilities through-out the city.

Assessment: The proposed forty-six (46) feet tall stealth WCF will include three sectors with a total of six antennas and concealed by an eight (8) foot wide by ten (10) foot tall cylindrical canister. The wireless communication facility is to be located at 2 W. University Boulevard is approximately 65 feet north of the University Boulevard right-of-way, adjacent to a private access/utility easement identified on a City Map as N. Ash Avenue. The Major Streets and Routes Map identifies University Boulevard as a collector street. The site is currently developed as a multi-family high density residential complex in the C-3 commercial zone and adjacent to the Dunbar Spring Neighborhood, a Historic District. The WCF is proposed on the southwestern portion of the site with the equipment shelter located just to the south of the stealth WCF pole.

A new twelve foot wide utility/access easement is proposed from University Boulevard to the WCF location. Ground equipment will be enclosed by an 8' tall masonry wall that will be painted to match the on-site development. The forty-six (46) foot tall Stealth WCF will be located adjacent to the ground equipment masonry wall enclosure lease area of approximately 18'x15'. The ground equipment will take up two parking spaces, plus a third parking space needed for the WCF technician.

Plans support a stealth design such as the proposed cylindrical canister designed to conceal the WCF antennas and to help mitigate height and soften the visual view sheds of the WCF from adjacent land uses. Staff supports stealth concepts to help provide context and add visual mitigation. Ground equipment and enclosure wall color theme to blend with existing on-site land uses.

Staff recommends the proposed WCF should be designed to support future collocation, antennas mounted as close to the monopole and screened by stealth design. Both monopole and antennas should be painted to complement the natural range of colors on surrounding trees, to mitigate and minimize visual impacts. Ground equipment shelter (cabinets) and masonry wall to be textured, finished, or painted to compliment the on-site land uses.

A plan amendment is not required. This request contains adequate information to process.
