SUMMARY: Engineering Division of Planning and Development Services Department has received and reviewed the proposed Development Plan Package. The following items need to be addressed:
1) Per previous comment 1 and Tucson Code Chapter 26-8(b)2d "The proposed floodplain management methods for floodproofing (existing nonresidential structure only) drainage control, detention, retention, and/or delineating and setting aside floodprone areas which result in mitigating a flood or erosion hazard on the proposed finished pads (elevations determined) and drainage slopes constructed to protect building foundations from runoff waters." Equipment pad needs to be shown elevated at least one foot above the floodplain 100 year water surface elevation. Alternatively the floodproofing method needs to be clear shown that protects the proposed equipment from flood waters. Please update the cabinet concrete slab detail 2 on sheet A-4 to indicate the appropriate elevation or floodproofing measures provided. An elevation certificate will be required if the slab/pad is to be elevated.
2) Per previous comment 2, the cabinet concrete slab detail is scaled to be about 45 feet south of the existing edge of centerline curb. If this is the case the Regulatory Base Flood Elevation that the slab must be elevated to is 2436.45. This is about 2 ½ feet higher than the adjacent natural grade called out on sheet LS-1. Please update plan accordingly.

FLOODPLAIN USE PERMIT: T16OT01001
PROJECT ADDRESS: 1919 N Tucson Bl, Tucson Arizona 85716 (in ROW to the east of this parcel; not on this parcel)
PROPERTY OWNER: City of Tucson right-of-way

The applicant is authorized to use a portion of the City of Tucson Flood Hazard Area within Wilson Wash floodplain within the Flowing Wells Wash (DG) watershed, specifically described as:

a portion of Tucson Boulevard right-of-way within the western median approximately 60-ft south of E Waverly St,

for the purpose of constructing cell tower improvements on an existing utility pole and utility cabinet on an elevated new concrete pad.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Unified Development Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following 10 conditions apply to this permit:

1) This permit becomes invalid and is subject to additional floodplain review, if any development changes the construction of the cell tower infrastructure, or, if there is any further disturbance within the floodplain other than that outlined in this application. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from the construction of cell tower infrastructure in the right-of-way and within stormwater conveyance area within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson.
2) All work shall conform to the approved plan sheets for the construction of the cell tower infrastructure which are made part of this permit. Any equipment associated with the cell tower not located on the replacement light pole shall be elevated 1-ft minimum above the base flood elevation. See sheet A-4 for elevated concrete pad details.
3) This Floodplain Use Permit and plans shall be kept in a readily accessible location on construction site at all times.
4) Any additional future disturbance of the floodplain shall have separate floodplain use permit applications submitted to this office for review and approval.
5) See the associated activity T16CM06421.
6) This permit is specific to the cell tower improvements at north end of existing median within the Tucson Boulevard right-of-way, east of parcel with the address 1919 N Tucson Bl, as indicated on the approved plans. It shall not apply to any other structure or property, whether attached or unattached, not specified under this permit.
7) PDSD Engineering Inspections are required prior to final floodplain permit approval. Call for elevation certification inspection / final inspections. 8) From floodplain data derived from Wilson Avenue floodplain data, the water surface BFE = 2435.38 NAVD88. Minimum pad FFE elevation = 2436.38 NAVD88.
9) Submit Elevation Certification(s) by a Land Surveyor registered in the State of Arizona for the concrete pad for the new cell tower utility cabinet pad to be constructed at location shown on plan sheet A-2. PDSD Engineering staff has the elevation certificate data available for RLS to use, as needed. Submit elevation certificate to the City of Tucson PDSD Engineering Division with color photos of the Finished Construction.
10) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. Disturbance of the floodplain is only permitted as per approved construction plans.

This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions are not complied with, as set forth in this permit.
