The applicant is authorized to use a portion of the FEMA AE zone (FIRM 2283L) and local Railroad WASH Ordinance watercourse flood hazard area in the City of Tucson, Arizona, on the property described as:
Parcel 130-01-0050 at 2965 E Fairland Sv, Tucson, AZ 85713, in a portion of Township 14 South, Range 14 East, Section 20,
for the purpose of maintenance activities along the north top of bank portion of the Railroad WASH Ordinance watercourse to facilitate use of railroad gantry activities.
The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.
The following 12 conditions apply to this permit T15OT00259:
1) Floodplain Engineering inspections required. For inspections contact Dave Roberts or other PDSD Engineering Inspection staff for pre-construction meeting and subsequent / periodic inspections as directed by Inspection staff.
2) All work shall conform to the exhibit and conditions of this permit, which is made part of this permit.
3) Within 5 (five) days of issuance of this permit, and through completion of the activities, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T16OT00259. FOR INFORMATION PLEASE CALL 791-5550."
4) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.
5) There shall be no disturbance of W.A.S.H. Ordinance watercourse channel, nor dumping of any vegetative or other debris into watercourse.
6) Vertical trimming of the existing vegetation will be located a distance of no more than 7-feet from railing. There shall be a maximum distance of 7-ft or less allowed for trimming southside of the railing.
7) Trimming existing vegetation to assure visibility of the existing signs will be allowed under this permit.
8) There shall be NO stockpiling within the Railroad Wash which runs along the southwest side of the parcel. There shall be NO disturbance within the Railroad Wash or other areas of top of bank or W.A.S.H. 50-foot Study Area except that which is specified under this permit.
9) Any disturbance activity outside of the limits shall be subject to notice of violation, Stop Work Order, citation, and/or other penalties.
10) This permit becomes invalid and is subject to additional floodplain review, if any required development permit changes the configuration of the structure and / or site development, or, if there is any further disturbance within the floodplain other than that outlined in the approved grading plans. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from development within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson.
11) This permit does not authorize grading, nor the construction of walls, building pads, or building of other structures. Any construction shall be authorized by a separate building permit.
12) This permit shall have a two-year expiration date.
This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit. Also, this permit will expire two years from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Division.
