The City of Tucson - Environmental Services Department (COT-ES) has completed our review of the 3428 N. Winding River Way property with respect to City of Tucson Ordinance No. 10037. City of Tucson Ordinance No. 10037 provides measures to protect the public's health and safety from potential adverse effects of methane gas at properties located near landfill sites. The 3428 N. Winding River Way property contains a single family residence. The property owner has submitted plans to Planning and Development Services for an addition to the existing residential structure.




The attached plan sheet shows the location of the 3428 N. Winding River Way property. The closed Walnut landfill is located to the west of the 3428 N. Winding River Way property along Paradise Falls Drive. The Walnut landfill is approximately 4.2 acres in size and accepted solid waste from 1961 to 1965. The 100 foot buffer zone around the Walnut landfill is shown with blue shading and the 500 foot buffer around the landfill is shown with purple shading on the plan sheet. A portion of the 3428 N. Winding River Way property is located within 500 feet of the Walnut landfill.



Section 29-24 in the Ordinance discusses development located between 100 and 500 feet of a landfill. The following factors, which may affect development, shall be considered for the Walnut landfill site and the 3428 N. Winding River Way property:



•Walnut landfill site assessment including the location of the site, operating history, groundwater test results, methane gas test results and other factors discussed in the Ordinance.
•Identification and review of any existing methane conditions within the landfill and any potential for migration of methane to the 3428 N. Winding River Way property.
•Identification and review of any extraction or mitigation systems if appropriate for the 3428 N. Winding River Way property.
•Identification and review of any special steps that may be taken in the construction of the building addition including provisions for control of methane migration within the structure.

The building owner shall submit a Self-Certification statement to COT-ES for review and approval. A copy of the Self-Certification statement form is attached for reference. As specified in Section 29-24 of the Ordinance, the necessary building permits can be issued only after approval of the Self-Certification statement by COT-ES.
