Background: This is a special exception land use request in a R-1 residential zone, to allow the installation and operation of a wireless communications facility (WCF) consisting of a monopalm communication tower with twelve (12) antennas, at a height of fifty (50) feet, including an unmanned pre-fabricated ground equipment shelter, located within a 20'x 38'8" lease area. The proposed WCF site will be located approximately 240 feet north of 29th Street ROW and 170 feet east of Sahuara Road ROW, at the address of 5949 East 29th Street. The applicant is proposing to locate the WCF ground equipment within an area screened by a twelve (12) foot tall masonry wall. The proposed diesel generator and associated ground equipment will be on a concrete pad located within the masonry wall. An eighteen (18) foot wide access easement for the WCF site will be provided from Sahuara Road. The nearest residential unit is located approximately 215 feet to the west of the proposed WCF site.

According to the Major Streets and Routes Plan, 29th Street is designated as a collector street.

Surrounding Zoning and Land Uses: Surrounding the WCF site to the north, east, south and southwest are zoned R-1 (Residential Zone) and developed with single family residential houses. Parcels to the west are zoned R-2 (Residential Zone) and are developed with a mix of multi-family residential and single-family residential uses.

Presubmittal Meeting: The applicant attended a presubmittal conference meeting on March 24, 2015. Meeting discussions included discussion of how to better mitigate visual impact on surrounding development, how to safeguard the site from children on the playground, and how to mitigate noise from the backup generators. The applicant was asked to use small live palms to help mitigate visual impact from monopalm.

Neighborhood Meeting: The applicant has held one neighborhood meeting, on April 29, 2015. The meeting was held at site of the proposed Wireless Communications Facility, located at 5949 East 29th Street. Applicant has provided the required neighborhood meeting material: mailing notification, copy of labels, notice letter, meeting summary, and sign-in sheet. Zero representatives from the neighborhood attended the meeting. The only person in attendance was Richard Murillo with Tucson Unified School District.

Land Use Policies: Plan Tucson identifies this area in the Future Growth Scenario Map as an "existing neighborhood" category. The Plan supports existing neighborhoods and commercial districts to encourage new services and amenities that contribute further to neighborhood stability. Plan Tucson, guidelines LT28.1.2, supports telecommunication facilities to be installed and maintained to minimize visual impact and preserve views. LT28.1.3 states that WCF to be designed with improved appearances of the above ground structures and utilities, and extend access to high-tech wireless communication facilities throughout the city.

Analysis: The applicant proposes a 50' tall wireless communications facility (WCF) disguised as a palm tree and ground equipment lease area (20' X 38'8") proposed at 5949 E. 29th Street. The proposed site is zoned R-1 residential and currently has an educational land use containing 6.67 acres. The ground level equipment lease area is proposed to be screened by a twelve (12) foot tall masonry wall that will be painted to match on-site buildings. Surrounding the WCF site to the north, east, south and southwest are zoned R-1 (Residential Zone) and developed with single family residential houses. Parcels to the west are zoned R-2 (Residential Zone) and are developed with a mix of multi-family and single-family residential uses. The nearest residential unit is approximately 215 feet west from the proposed WCF and ground equipment lease area.

The special exception site is located within the "existing neighborhood" area identified in Plan Tucson. The Plan supports existing neighborhoods and commercial districts to encourage new services and amenities that contribute further to neighborhood stability. Specific direction is provided in Chapter 3 - The Built Environment, under Guidelines LT28.1.2 and LT28.1.3. These policies support telecommunication facilities when they are installed and maintained to minimize visual impact and preserve views, and their design improves the appearance of above ground utilities and structures.

Staff acknowledges that it is difficult to disguise a fifty (50) foot tall stealth WCF monopalm and the proposed monopalm at a height of 50 feet will be visible from surrounding areas. Staff suggests the applicant consider visual impact mitigation as the site abuts residential development which includes single-family, and multi-family residential. Additional live palms should be used to help buffer the monopalm from the school and adjacent residential neighborhood. Staff recommends the proposed WCF should be designed to support future collocation, antennas mounted as close to the monopole and screened by the monopalm stealth design. Both monopalm and antennas should be painted to complement the natural range of colors on palm trees, to mitigate and minimize visual impacts. Ground equipment shelter (cabinets) and masonry wall to be textured, finished, or painted to compliment the on-site land uses. A stealth design helps mitigate and disguise the WCF. There are several live palm trees of approximately thirty (30) feet in height in the area which can help blend in with a monopalm WCF. The proposed location for the ground equipment which, includes one generator, appears to be located just east of the school buildings and south of the existing basketball courts.

Plan policy supports compatibility and visual impacts and noise mitigation are expected to be minimized through site design of the WCF and to be addressed in the Design Compatibility Report (DCR). The special exception submittal addresses compatibility issues and will be subject to being consistent with the general direction of the applicable Plans. In addition, staff recommends that any future graffiti visible from the public right-of-way be removed within seventy-two (72) hours of observation. Staff acknowledges that the proposed WCF tower will help improve telecom services to the established neighborhoods and businesses in the area. The proposal is in general compliance Plan Tucson, and does not require a plan amendment. Staff offers the following special exception conditions for consideration:


1. Any existing on-site palm tree, native tree or landscape planting disturbed during the monopalm construction or ground equipment installation shall be replaced in accordance with the UDC and heat island mitigation;

PDSD Engineering Division has reviewed the proposed Special Exception documentation for the proposed 50-foot monopalm wireless communication facility with associated equipment at the west central portion of the parcel. The proposed improvement is located within a site that is appears to be impacted by a jurisdictional floodplain of the Arcadia Wash. The City has limited hydrologic data for this floodplain and a preliminary assessment of the floodplain indicates the proposed project is at the edge or within the jurisdictional floodplain. The site is already developed with school improvements and the proposed disturbance does not appear to require PRA (protected riparian floodplain) review by Engineering, however equipment within the floodplain shall be floodproofed by elevating the service equipment for this structure to meet flood regulations.

Engineering advises the following considerations for this request, based on Technical Manual Section 4-04.2.3.1 and Tucson Code Section 26-11:
1) Prior to submitting the plans for review, address the following comments:
a. Revise Flood Zone data on sheet LS-1; verbiage needs to correctly describe flood zone conditions. The project is located in local jurisdictional floodplain of the City of Tucson Flood Hazard watercourse of Arcadia Wash which is within FEMA Flood Zone X unshaded per FIRM panel 2303 L, which are considered areas determined to be outside of the 0.2% annual chance floodplain. The jurisdictional floodplain (100-year flood area) is expected to cover the western portion of the subject parcel.
b. Show on plans by use of profile section and by adding notes that equipment shelter and meter for this proposed structure shall be elevated to a minimum of 2 feet above existing grade.
c. In lieu of the above comments a & b, applicant may choose to provide a hydrology report for this portion of the Arcadia Wash that verifies the location of the flood limits and depth of the jurisdictional flood. If the proposed project is determined to be located in a jurisdictional floodplain, plans will need to show flood limits and water surface elevation on plans based on the approved hydrology report. Elevating equipment would be determined based on regulatory flood depth derived from an approved report (Depth of floodplain plus 1-ft freeboard).
2) A floodplain use permit will be required at time of permitting for this project.
3) Clarify total disturbance area for the project on plans.
4) Provide recordation information for access easement on plans for submittal review.
06/11/2015 DBURSUC1 REZ AGENCY REVIEW PARKS & RECREATION Completed The basketball courts at Corbett Elementary School are a shared-use facility governed by an IGA between Tucson Parks and Recreation and the Tucson Unified School District. This IGA allows for public use of the courts during off-school hours. During these off-school hours, the courts are not supervised. The proposed wireless facility is located approximately 9' from the edge of these basketball courts. There is a basketball goal located across from the facility such that an errant shot could land a basketball on top of the facility. I have a concern that the existing design will cause balls to be stuck on top of the flat chain link cover over the compound and that, lacking playground supervision during off-school hours, children will find a way to climb the wall and walk on the chain link to retrieve their ball. I would propose that the chain link cover be designed with a slope to prevent this potential occurrence.
