Background: This is a special exception land use request in a C-1 commercial zone, to allow a proposed Retail / Thrift Store with donation center use. The proposed use will be located within an existing commercial center / building, with a designated unit / space of 15,946 square feet. The special exception site is located at 250 North Pantano Road, on the east side of Pantano Road approximately 1,000 feet north of the Broadway Boulevard / Pantano Road intersection. Access is provided from Pantano Road.

According to the Major Streets and Routes Plan, Pantano Road is designated as an arterial roadway.

Surrounding Zoning and Land Uses: Surrounding the WCF site to the north and east are zoned R-3 (Residential Zone) and developed with multi-family residential. Parcels to the west (across Pantano Road) are zoned C-2 (Commercial Zone) and are developed with big box retail uses. Parcels to the south are zoned C-1 (Commercial Zone) and developed with big box retail uses.

Rezoning Presubmittal Meeting: The applicant attended a presubmittal conference meeting with staff on September 23, 2014. Issues discussed: provide a revised preliminary development plan showing the whole project site including the store and donation area, site details as required by code, hours of operation, etc.

Neighborhood Meeting: The applicant held a neighborhood meeting on December 22, 2014 onsite at a proposed store location. There were two attendees at the meeting. There were no concerns raised and per the meeting notes, the attendees expressed that they welcomed the new business to the center.

Land Use Policies: Plan Tucson provides relevant policy guidance and identifies this site on its Future Growth Scenario Map as existing neighborhoods which are primarily developed and largely built-out as residential and commercial districts in which minimal new development is expected. The goal is to maintain existing character of these neighborhoods, encourage new development and reinvestment and new services that contribute further to neighborhood stability. Plan Tucson encourages design elements that reflect project sensitivity to the site, surrounding neighborhoods, and enhances the overall function and visual quality of the street, adjacent properties, and the community.

Pantano East Area Plan promotes commercial development in appropriate areas such as along major streets and where existing commercial zoning already exists. Commercial uses should be integrated with other adjacent commercial uses and designed in harmony with adjacent residential uses.

These Plan policies encourage and support developments that respond to physical characteristics of the site, adjacent land use patterns, enhancing the visual appeal of the streetscape, and incorporating neighborhood recommendations into site planning and design.

Analysis: The applicant proposes a Retail / Thrift Store with donation center within an existing commercial shopping center zoned C-1 Commercial Zone at 250 North Pantano Road. The proposed use will occupy a unit / space consisting of 15,946 square feet.

The special exception site is located within the existing neighborhoods area identified in Plan Tucson, which are primarily developed and largely built-out residential and commercial districts in which minimal new development is expected. The goal is to maintain existing character of these neighborhoods, encourage new development and reinvestment and new services that contribute further to neighborhood stability. Plan Tucson encourages design elements that reflect project sensitivity to the site, surrounding neighborhoods, and enhances the overall function and visual quality of the street, adjacent properties, and the community. Specific policies that pertain to this are LT28.1.1, LT28.1.7, LT28.1.11, and LT28.6.6. Staff feels Plan Tucson supports the use of this existing structure for the proposed retail / thrift store use.

Pantano East Area Plan (PEAP) promotes commercial development in appropriate areas such as along major streets and where existing commercial zoning already exists. Commercial uses should be integrated with other adjacent commercial uses and designed in harmony with adjacent residential uses. This is reflected in commercial policy 1 and commercial policy 1.A. The current plan for InJoy Thrift Stores is supported by the policies set forth in the Pantano East Area Plan.

Recommendation: In general, the proposal meets the intent of Plan Tucson and the Pantano East Area Plan policy direction regarding the compatibility with the scale and character of the surrounding development. Staff offers the following Special Exception conditions for consideration:

1. The development package shall be in substantial compliance with the Preliminary Development Plan, Design Compatibility Report (DCR) and a Security Management Plan (SMP) submitted on April 9, 2015 which clearly illustrates compliance with all conditions through the use of details, diagrams and/or notes.

2. Hours of operation for drop off/pick-up of donated items, trash pick-up, and outdoor activities to be limited to 9 a.m. to 9 p.m. in compliance with the submitted Security Management Plan (April 9, 2015).

3. No outdoor open storage of donated goods, unwanted donations, or large trash/waste collections. Any offsite after hour donations/refuse to be cleaned up daily by 9:00 a.m. in compliance with the submitted Security Management Plan (April 9, 2015).

4. Any new outdoor lighting shall be located on buildings only, low sodium or equivalent, shielded and directed away from adjacent residential neighbors located to the north. Light element shall be placed at a height not to exceed the height of the building on which it is mounted.
