COMMENTS: the following comments are relative to an application for a Board of Adjustment (B of A) (UDC 3.10.1).


This site is located in the SR zone (UDC 4.7.4). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-1).


COMMENT: Owner proposes to construct a new detached garage along the east perimeter yard that is 1,600 square feet in size 24 feet in height to the top of the roof ridge.

Per UDC Section 6.6.6.3.C allows a Maximum height of 12 feet for a detached accessory structure to the midpoint of the gable roof. The owner proposes a detached structure with a height of 23 feet to the midpoint of the gable roof. A Board of Adjustment variance to allow the height to exceed 12 feet is required.

The square footage of the existing dwelling is 2,863 sq. ft. and the overall square footage of the accessory structures is 2,901 sq. ft. Per Section 6.6.3.D, the allowed maximum square footage allowed for a detached accessory structure is up to 50% of the principal dwelling. The overall square footage of detached accessory structures is greater than 50%, it exceeds the square footage by 51%.

Per UDC Article 6 section 6.6.3.C and .D SPECIFICALLY WITHIN RESIDENTIAL ZONES

The buildings used for an accessory use within a residential zone shall comply with the following:

C. Accessory structures shall not exceed 12 feet in height, unless attached to a principal structure. If attached to the principal structure, maximum height permitted shall be the same as for the principal structure; and,
D. The total gross floor area (gfa) of all accessory structures shall not exceed 50% of the gfa of the principal structure. Accessory structures less than 200 square feet gfa are exempt from this requirement.
