The applicant is authorized to use a portion of the FEMA Special Flood Hazard Area Zone AO2 per the Flood Insurance Rate Maps 04019C2276L, specifically described as:

A portion of Parcel 116-19-0740

For the purpose of installing a carport with a photovoltaic system on top.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard Area Regulations. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Unified Development Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations require application for review and approval of an additional Floodplain Use Permit.

The following 9 conditions apply to this permit:

1) This permit becomes invalid and is subject to additional floodplain review, if any required development changes the construction of the photovoltaic system, or, if there is any further disturbance within the floodplain other than that outlined in this application. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from the construction of the system within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson.

2) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.

3) All work shall conform to the approved Details and General site plan sheets for the construction of the carport, which are made part of this permit. The carport must remain open sided and can never be enclosed to a habitable structure.

4) All electrical equipment is to be elevated to 3-feet above highest adjacent grade or be designed to be submerged in 2 feet of water for a period of 30 minutes.

5) Within 5 (five) days of issuance of this permit, and through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "Construction proceeding under requirements of City of Tucson Floodplain Use Permit # T15OT00272 For information please call 791-5550."

6) This Floodplain Use Permit and plans shall be kept in a readily accessible location on site at all times.

7) Any additional future disturbance of the floodplain shall have separate floodplain use permit applications submitted to this office for review and approval.

9) This permit is specific to the improvements for 233 N Main Ave as indicated on the approved plans. It shall not apply to any other structure or property, whether attached or unattached, not specified under this permit.

Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Planning & Development Services Department, Engineering Division. This permit may be renewed for up to one year at the sole discretion of the City Engineer or designated representatives.

This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions are not complied with, as set forth in this permit.

This site is in the HO-3 Zone. Historic review is required (UDC Sections 3.3.7 and 5.8.5). (This project needs to be scheduled for historic review.)

A single-family residence is a permitted use in this zone (UDC Section 4.7.15).

The minimum setback is the greater of ten (10) feet, or three-fourths (3/4) the height of the structure's wall facing each interior property line (Table 6.3-3.A). The required setback to the south property line is ten (10) feet. The proposed setback for the proposed detached carport with solar panels is five (5) feet, six (6) inches.
