09/24/2015 | MPADILL1 | COMMUNITY PLANNING | REVIEW | Completed | PLANNING & DEVELOPMENT SERVICES DEPARTMENT SE-14-89 AT&T - 4240 N. 1st Avenue C-1 Commercial Zone (Special Exception) NORTHSIDE AREA PLAN (NSAP) AND Plan Tucson 09/24/2015 msp Background: This proposal is for a special exception consideration in the C-1 commercial zone to allow installation of a wireless communication facility (WCF), consisting of a sixty-five (65') foot tall monopole with ground mounted equipment in a pre-fab shelter and a diesel generator and a 90 gallon fuel tank. Top of antennas will be at a height of sixty-seven (67') feet. The lease area will be approximately 20' X 40' square feet. The WCF and associated ground equipment will be located adjacent to the rear façade (east) of the commercial strip complex building, approximately four hundred and ninety eight (498) feet from Limberlost Drive right-of-way and two hundred twenty one (221) feet from the east property line of the commercial site. The nearest property line is northeast at one hundred and fifty eight (158) feet. A multi-family residential development is located to the east with the nearest multi-family three story structure at approximately three hundred and twenty (320) feet from the proposed WCF site. Primary access for the WCF will be using existing on-site PAALS and identified by a twelve (12) foot wide access easement from Limberlost Drive to the WCF site. The special exception site is located at 4240 North 1st Avenue, at the northeast corner of 1st Avenue and Limberlost Drive. The overall commercial site has multiple parcels with 13.02-acres. The site functions as one development with commercial retail, restaurants and a fitness center. According to the Major Streets and Routes Plan, 1st Avenue is an arterial street and Limberlost Drive a local street. Surrounding Uses/Zoning: The special exception site has C-1 commercial zone with multiple tenants with a variety of retail and restaurants and a fitness center. To the immediate north and west abutting the special exception site are C-2 commercial zoned parcels with a mix of individual land uses including; automotive repair services, pet clinic, and an office complex. To the east is R-3 high density residential zone developed with a multi-family three-story complex with over one hundred units. To the south across Limberlost Drive are C-1 commercial, O-3 Office, and R-2 medium density residential with parcels that include; convenience store, single story apartments, and single-story condo/townhomes; to the west across 1st Avenue is R-3 zone a high density residential zone with a two and three story multi-family complex with over two hundred (200) units. The proposed monopole will be approximately two hundred twenty one (221) feet from the nearest residentially zoned and developed parcel, with the nearest resident unit approximately three hundred and twenty (320) feet to the northeast of the proposed WCF site. Rezoning Presubmittal Meeting: The applicant attended a rezoning (Special Exception) presubmittal conference meeting with staff on May 21, 2014. Special Exception/Rezoning Neighborhood Meeting: Applicant has provided the required neighborhood meeting material: mailing notification, copy of labels, notice letter, meeting summary, and sign-in sheet. The applicant held a neighborhood meeting on July 14, 2014, a second follow-up neighborhood meeting was held on August 26, 2014, with sigh-in sheet indicating twelve (12) persons were in attendance. Minutes state area residents were in general support of a wireless communication facility, subject to a stipulation that instead of monopalm stealth design, use instead a monopole design using corten steel with a rusted dark finish, which allows for future potential collocation of carriers. Corten steel is the product currently used by Tucson Electric Power Company on major power line poles made of steel with a dark rusty color finish. A third and final neighborhood meeting was held on July 30, 2015 with the meeting sign-in sheet indicting three persons were in attendance. Minutes indicate that overall the attendees agreed the area was in need of better WCF services and agreed the proposal was necessary to improve services. Discussion - Plan Compliance and Recommendation: The proposed site is within the Northside Area Plan and Plan Tucson. Although the Northside Area Plan does not have specific language for wireless communication facilities, it does support commercial development at this location. Plan Tucson policy direction as it relates to wireless communication facilities as stated in Chapter 3, the Built Environment, under Guidelines LT28.1.2 and LT28.1.3, stating that telecommunication facilities should maintain and minimize visual impacts and preserve views. Policy further states; to improve the appearance of above-ground utilities and structures, located throughout the city. Visual impacts are a key consideration during the review process. The proposed special exception request to consider a WCF in the I-1 Industrial zone is in general compliance with Plan policy. Land Use Policies: Policy direction is provided by the Plan Tucson. Policy direction is provided by the Plan Tucson. The proposed site for the monopole height extension is located within a Mixed-Use Center area as identified by Plan Tucson. A Mixed-Use Center provides a higher-intensity mix of jobs, services, and housing along major streets. The businesses and residences within these corridors will be served by a mix of high-frequency transit options, as well as pedestrian and bicycle facilities. In particular to wireless communication facility, Plan Tucson provides direction and support in Chapter 3 - The Built Environment, under Guidelines LT28.1.2, LT28.1.3 which state telecommunication facilities be installed and maintained to minimize visual impact and preserve views and to improve the appearance of above ground utilities and structures and extend access to high-tech wireless communication facilities through out the city. Assessment: The applicant proposes a wireless communication facility within a C-1 commercial zoned and development site, 4240 N. 1st Avenue. The applicant is proposing to install a monopole at a height of sixty five (65') feet with the top of antenna array at sixty seven (67') feet in height. The proposed ground equipment will be within a lease area of approximately 20' X 40'to be located at along the rear (east) façade of an existing commercial complex located at the northeast corner of 1st Avenue and Limberlost Drive. The proposed location for the WCF is identified in the original development plan as a loading zone area. Applicant needs to contact Mr. David Rivera at (520) 837-4957, or staff in Zoning Review to determine if this issue needs a revised development plan/tentative plat or other options to resolve loading zone requirements. Primary access for the WCF will be using existing on-site PAALS and identified by a twelve (12) foot wide access easement from Limberlost Drive to the WCF site. Staff recommends prior to recordation of access easement for applicant to review with Zoning Review staff proposed location of WCF. Staff acknowledges that it is difficult to disguise a 65 foot tall monopole. Mitigation measures supported by staff include; antennas and other attachments be placed as close to the monopole as practical and all painted to minimize visual impacts. Neighborhood meeting minutes dated August 26, 2014 states area residents may in general support a monopole if designed with Corten Steel and finished in a rust dark color, instead of a steal monopalm. Corten steel is the finish currently used by Tucson Electric Power Company on major power poles made of steel and finished in a rusty dark color. Any potential noise levels generated by ground equipment will need to be addressed on the required Design Compatibility Report. The WCF is most visible to the adjacent multi-family apartment complex located to the east. The nearest residential unit on the apartment complex is approximately 320 feet to the northeast. Ground equipment screening will need to addressed, as it applies to view sheds to the east. Testing of diesel generator should only occur during day light hours as needed. The full special exception submittal to address applicable policy compliance and will be subject to being consistent with the general direction of the applicable Plans. In addition, staff will recommend that any future graffiti visible from the public right-of-way be removed within 72 hours of observation. Staff acknowledges that the proposed cell tower will help improve telecom services to the established neighborhoods and businesses in the area. The proposal is in general compliance with Northside Area Plan and Plan Tucson, and does not require a plan amendment. Staff believes the following special exception conditions can be used to address compatibility: 1. Emergency diesel generator shall be designed and equipped to minimize noise impacts to adjacent residential developments. Testing of generator shall be limited to day light hours; " PT, Chapter 3, The Built Environment, Set 1 All Developments, Guidelines - LT28.1.2, and LT28.1.3 2. Maximum height of monopole shall not exceed 67 feet, as measured to top of antennas, as shown on Preliminary Development Plan dated January 12, 2015; " PT, Chapter 3, The Built Environment, Set 1 All Developments, Guidelines - LT28.1.2, and LT28.1.3 3. Any graffiti visible from the public right-of-way or area residential development shall be removed within 72 hours of observation; " PT, Chapter 3, The Built Environment, Set 1 All Developments, Guidelines - LT28.1.2, and LT28.1.3 4. Ground equipment to be located within lease area and enclosed by a ten foot tall masonry wall with surface texture and color to match adjacent on-site trash enclosure, as shown on Preliminary Development Plan dated January 12, 2015; " PT, Chapter 3, The Built Environment, Set 1 All Developments, Guidelines - LT28.1.2, and LT28.1.3 5. Full length of monopole surface shall be corten steel finish to minimize visual impacts.
