Top of antennas will be at a height of eighty (80) feet. The lease area will be approximately 12 X 48 square feet and located at the southeast corner of the parcel. Primary access for the WCF is shown to be from the adjacent fifteen foot wide alley which includes Tucson Electric Power Company overhead power lines. The site is at 596 E. 23rd Street, located along a strip of industrial zoned parcels parallel with the Union Pacific Railroad, on the western edge of an industrial zoned and developed area, which abuts a residential neighborhood located to the west of the proposed special exception site. The site is located southeast from the intersection of 22nd Street and 2nd Avenue. The overall site is industrial zoned and developed with four contiguous four parcels with a combined land area of approximately 21,811 square feet (.69 acres). The site functions as one development for automotive paint and repair services. According to the Major Streets and Routes Plan, 23rd Street is a local street. Surrounding Uses/Zoning: The subject site land use zone is I-1 Light Industrial zone. To the north and south are I-1 Light Industrial zoned, developed parcels, and to the east across the Union Pacific Railroad tracks is zoned I-1 Light Industrial and developed with commercial and industrial land uses. To the west are vacant parcels zoned I-1 Light Industrial and R-2 Medium Density Residential zones. Further west, beyond these vacant parcels across 2nd Street is the edge of an established residential neighborhood zoned R-2 Medium Density Residential development with single-family homes. The proposed monopole will be approximately two hundred (200) feet from the nearest vacant residentially zoned parcel and approximately four hundred and forty (440) feet from the nearest residential home, both located to the west of the proposed wireless communication facility. Rezoning Presubmittal Meeting: The applicant attended a rezoning (Special Exception) presubmittal conference meeting with staff on March 12, 2014. Special Exception/Rezoning Neighborhood Meeting: Applicant has provided required neighborhood meeting material: mailing notification, copy of labels, notice letter, meeting summary, and sign-in sheet. The applicant held an on-site (Formula 1 Automotive/Paint Shop), neighborhood meeting at 596 E. 23rd Street, on April 24, 2014 from 5:00 p.m. to 6:30 p.m. The meeting was attended by two area residents, plus applicant and associates, totaling seven in attendance. The minutes are minimal and presented in an e-mail from the applicant to staff, and states the two attendees were in general support of the proposed Special Exception consideration for a WCF. Discussion - Plan Compliance and Recommendation: The proposed site is within the Old Pueblo South Community Plan and Plan Tucson. Policy direction as it relates to wireless communication facilities is provided in Plan Tucson, as stated in Chapter 3, the Built Environment, under Guidelines LT28.1.2 and LT28.1.3, stating that telecommunication facilities should maintain and minimize visual impacts and preserve views. Further stating to improve the appearance of above-ground utilities and structures, located throughout the city. Visual impacts are a key consideration during the review process. The Old Pueblo South Community Plan provides Policy direction on Community Facilities to provide landscaping buffers and a General Policy to start a systematic program of sidewalk construction. The proposed special exception request to consider a WCF in the I-1 Industrial zone is in general compliance with Plan policy. Land Use Policies: Policy direction is provided by the Plan Tucson. Policy direction is provided by the Plan Tucson. The proposed site for the monopole height extension is located within a Mixed-Use Center area as identified by Plan Tucson. A Mixed-Use Center supports a variety of retail, services, office, and public gathering places, located close to each other, providing occupants of the center and the residents and workers in the surrounding neighborhoods with local access to goods and services. In particular to wireless communication facility, Plan Tucson provides direction and support in Chapter 3 - The Built Environment, under Guidelines LT28.1.2, LT28.1.3 which state telecommunication facilities be installed and maintained to minimize visual impact and preserve views and to improve the appearance of above ground utilities and structures and extend access to high-tech wireless communication facilities through out the city. Assessment: The applicant proposes a wireless communication facility within an I-1 Light Industrial zoned and development area, located at 596 E. 23rd Street. The applicant is proposing to install a monopole at a height of eighty (80) feet with the top of antenna array at eighty (80) feet in height. The proposed ground equipment will be within a lease area of approximately 12' X 48'to be located at the southeast corner of the overall complex, between the existing building and the alley way within an open area enclosed by an existing perimeter wall. The south boundary of the site has an existing masonry wall of unknown height and indicates an existing walk-through gate from the alley will be used to allow access onto the wireless communication facility. In addition a proposed ten foot wide gate is being proposed to provide access to the WCF from the alley located to the south. Within the alley is an existing Tucson Electric Power overhead power line which abuts the proposed on-site WCF site. Community Planning staff has concerns of an eighty-foot tall WCF adjacent to electric power lines. Applicant to address safety issues during install of WCF with heavy equipment (cranes, loaders, etc.), and any issues with monopole being at close proximity to the T.E.P overhead power lines. Staff recommends vehicle and personnel access be provided on-site and accessed provided from 23rd Street. Since the site contains four parcels and on-site access will be from an adjacent parcel, staff also recommends a cross-access easement be recorded as part of the proposed special exception request. Staff acknowledges that it is difficult to disguise an 80 foot tall monopole. Mitigation measures supported by staff include; antennas and other attachments to be painted to minimize visual impacts. Any potential noise levels to be generated by ground equipment will need to be addressed on the required Design Compatibility Report. Although the nearest existing home is approximately 440 feet to the northwest, there are three vacant residential zoned parcels located approximately 200 feet to the west and noise mitigation plan needs to address this issue. The full special exception submittal to address applicable policy compliance and will be subject to being consistent with the general direction of the applicable Plans. In addition, staff will recommend that any future graffiti visible from the public right-of-way be removed within ten working days of observation. Staff acknowledges that the proposed cell tower will help improve telecom services to the established neighborhoods and businesses in the area. The proposal is consistent with the Old Pueblo South Community Plan and Plan Tucson, and does not require a plan amendment. Staff recommends that the Special Exception/Rezoning application be distributed for the full review process. Staff believes special exception conditions can be used to address compatibility concerns. Anticipated issues include: " Provide an on-site cross-access easement. " Address safety issues with the adjacent T.E.P. overhead power lines, " Address access to existing electric service panels located on south wall of existing building (same area as ground equipment lease area), " Provide a one-foot no access easement along the south and east boundary of subject parcel " Monopole shall not exceed 80 feet in height; " Monopole and ground equipment be painted to minimize visual impacts; " Ground equipment to be located within an enclosed shelter, as represented; " Ground equipment to be screened by an existing masonry wall (as proposed).
