09/29/2014 | LOREN MAKUS | ENGINEERING | REVIEW | Approved | November 5, 2014 FLOODPLAIN USE PERMIT NO.: T14OT0824 ADDRESS: 1310 N Alvernon Way, Tucson Arizona 85712 PROPERTY OWNER: Deed & Note Traders LLC, 1302 N Alvernon Way, Tucson AZ 85712 The applicant is authorized to use a portion of the City of Tucson Flood Hazard Area per the Alvernon Wash delineation, specifically described as: A portion of Parcel 122-13-073B, Speedway No 1 N60'S90' Lot 4 Exec E210' & Exec W7.40' BLK 5 For the purpose of constructing PV Solar on roof of largest structure, and separate shade structure over parking area on north side. The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit. The following 16 conditions apply to this permit: 1) All improvements proposed under this permit will be cumulative in percentage, to include this project. 2) This permit becomes invalid and is subject to additional floodplain review, if any required development changes the construction of the CMU block wall, or, if there is any further disturbance within the floodplain other than that outlined in this application. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from the construction of a CMU block wall within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson. 3) The proposed improvements shall not impose conditions that would increase the flood damage potential to the combined proposed and existing building, by 50 percent or greater of the existing structure's value. 4) A cost estimate was provided showing that the improvements are less than 50 % (estimate was $25,674, 23.2%) of the Assessed Value ($110,754) based on 3 bldgs sqft: 700,1200, 1800, larger bldg. 48.6% of $227,888, as shown on the Pima County Assessors Website, with a max. available for larger bldg. of $55,376.80. No person shall repair or alter property in a piecemeal manner so as to avoid the provisions of Section 26-4.1.a.3, Chapter 26-Tucson Code. The estimate will be recorded and if piecemeal permits for this construction are applied for the cost estimate will be added to it. 5) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. 6) All work shall conform to the approved site plan sheets for the construction of the 50 LF x 6' high CMU block wall, which are made part of this permit. 7) The CMU wall must be constructed with drainage vents in the wall per the legend on the site plan. 8) Within 5 (five) days of issuance of this permit, and through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T10OT02246 FOR INFORMATION PLEASE CALL 791-5550." 9) Any additional future disturbance of the floodplain shall have separate floodplain use permit applications submitted to this office for review and approval. 10) Any future permanent, freestanding walls or other structures shall have separate floodplain use permit applications submitted to this office for review and approval. 11) See the associated activity T14CM03155. 12) This Floodplain Use Permit is issued concurrently with the improvement plans/permit. Copies of these documents shall be kept in a readily accessible location on site at all times. 13) An application/processing fee of $50.00 (submittal fee) must accompany each future request for work to be authorized under this floodplain use permit. Engineering study review fees of $150.00 may be imposed based upon the fee schedule in the current floodplain ordinance. 14) The applicant attests to the fact that the plans and documents submitted represent all of the improvements that will be done to the existing building, and that all additions, improvements or repairs to the building are included in the construction plans and/or documents herewith. No other improvements, repairs, reconstruction, additions or remodeling have been made to the structure that is not indicated in the attached plans and/or documents. 15) Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Planning & Development Services Department, Engineering Division. This permit may be renewed for up to one year at the sole discretion of the City Engineer or designated representatives. 16) This permit is specific to the improvements for 1310 N Alvernon Wy as indicated on the approved plans. It shall not apply to any other structure or property, whether attached or unattached, not specified under this permit. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Division. This permit may be renewed for up to one year, in the absence of Registered Plant authorization, at the sole discretion of the City Engineer or designated representatives. This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions are not complied with, as set forth in this permit.
