The Applicant/Owner is authorized to use a portion of the City of Tucson Bronx Wash Flood Hazard Area, as delineated by FEMA on FIRM Panel #2276L for the property described as:

Parcel at 1475 N Oracle Road, Tucson, AZ 85705

For the purpose of Lobby Renovation, as shown on the Site Plan T14CM02460. The approved Site Plan becomes part of this Floodplain Use Permit.

The Applicant/owner agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the Applicant/Owner. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following conditions shall apply to this permit (Refer to Chapter 26 "FLOODPLAIN, STORMWATER AND EROSION HAZARD MANAGEMENT" for additional information):

1. All improvements proposed under this permit will be cumulative in percentage, to include this project.
2. The proposed improvements shall not impose conditions that would increase the flood damage potential to the combined proposed and existing building, by 50 percent or greater of the existing structure's value.
3. A cost estimate was provided showing that the improvements are less than 50% (estimate was $25,000.00, which translates into 0.76%) of the assessed value ($3,268,461.00), as assessed by County Assessor. The calculated 0.76% shall be added to cost percentages for future. No person shall repair or alter property in a piecemeal manner so as to avoid the provisions of Section 26-4.1.a.3, Chapter 26-Tucson Code. The estimate will be recorded and if piecemeal permits for this construction are applied for the cost estimate will be added to it.
4. All work shall conform to the approved Details and Site Plan sheets (T14CM02460) which are made part of this permit.
5. Except as approved by the City Engineer prior to the start of construction, the proposed improvements, under this Permit, shall not obstruct or divert the existing drainage patterns or flow of floodwaters from or to adjacent properties other than what is shown on the attached approved Site Plan.
6. Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "Construction proceeding under requirements of City of Tucson Floodplain Use Permit No. T14OT00531. For more information please call 791-5550."
7. This Floodplain Use Permit is issued concurrently with the Site Plan (T14CM02460) permit. Copies of these documents shall be kept in a readily accessible location on site at all times.
8. The applicant attests to the fact that the plans and documents submitted represent all of the improvements that will be done to the existing building, and that all additions, improvements or repairs to the building are included in the construction plans and/or documents herewith. No other improvements, repairs, reconstruction, additions or remodeling have been made to the structure that is not indicated in the attached plans and/or documents.
9. This permit becomes invalid and is subject to additional floodplain review, if any required development permit (s') changes the configuration of the structure and or site development.

This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions are not complied with, as set forth in this permit. Additionally, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Planning and Development Services Department, Engineering Division. This permit may be renewed for up to one year at the sole discretion of the City Engineer or designated representatives.
