The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Unified Development Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit. This floodplain use permit is issued with the following 7 conditions: 1) The applicant is authorized to use a portion of the City of Tucson Flood Hazard Area per the 18th St Wash delineation per the approximate flood-hazard area study prepared by JE Fuller Hydrology & Geomorphology Inc., 19APR07. 2) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. 3) Per the submitted Elevation Certificate, T14OT00051 dated 04FEB14, the existing building has a finish floor elevation of 2490.2 feet NAVD. The FFE is 0.1 feet below the regulatory flood elevation however it is higher than the base flood elevation and per the Floodplain Administrator, Jim Vogelsberg the structure can be reviewed and approved for the fire damage repair and is to be considered a conforming structure. 4) All proposed work is to be interior to the building and no work shall be completed outside of the building without submitting new plans and permits to verify conformance with Chapter 26 of the Tucson Code. 5) Any additional future disturbance of the floodplain shall have separate floodplain use permit applications submitted to this office for review and approval. 6) All work shall conform to the approved site plan, T1CM07442 which is made part of this permit. 7) This permit is specific to the improvements for 2026 E Poquita Vista as indicated on the approved plans. It shall not apply to any other structure or property, whether attached or unattached, not specified under this permit. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Planning & Development Services Department, Engineering Division. This permit may be renewed for up to one year at the sole discretion of the City Engineer or designated representatives. This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions are not complied with, as set forth in this permit.
