COMMENTS: The following comments are for the purpose of applying for a variance before the Board of Adjustment (UDC Section 3.10.1).

This site is located in the R-2 zone (UDC 4.7.9). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.6, .9 & .10.

The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure's wall facing each interior property line (Table 6.3-2.A). The setback for the garage (#1) to west property line is zero (0) feet. The setback for the garage (#2) and carport to the east property line is four (4) feet.

The minimum setback to the front street perimeter property line is the greater of twenty (20) feet, or one and one-half (1 ½) the height of the proposed wall ((UDC 6.4.5.C.1.a). The setback for the proposed carport attachment to the front property line is twelve (12) feet.

Detached accessory buildings are not permitted in the buildable area extending the full width of the lot between the principal building and the front street lot line (UDC 6.6.3.B). There are two (2) detached garages, that require permits in the front yard. A carport attachment is also proposed for the garage (#2) along the east side of the front yard.

"The total gross floor area (gfa) of all accessory structures shall not exceed 50% of the gfa of the principal structure" (DC Section 6.6.3.D). The gfa of the two (2) garages and the carport exceed the gfa of the existing SFR.

Garage (#1), based on a wall height of 11'-0" the required perimeter yard setback to the west property line is 7'-4", proposed perimeter yard setback to the west property line is zero (0) feet. Garage (#2) and carport, based on a wall height of 11'-0" the required perimeter yard setback to the east property line is 7'-4", proposed perimeter yard setback to the east property line is 4'-0".

The minimum street perimeter yard setback to the front street perimeter property line is the greater of twenty (20) feet, or one and one-half (1 ½) the height of the proposed wall ((UDC 6.4.5.C.1.a). Based on a wall height of less than 13'-4" the required street perimeter yard setback for the proposed attached carport is 20'-0", proposed street perimeter yard setback is twelve 12'-0".
